`1 UEI has also asserted against Peel the following U.S. Patents that are related to the ‘309 Patent: 7,821,504
`(“the ‘504 Patent”), 7,821,505 (“the ‘505 Patent”) and 7,999,794 (“the ‘794 Patent). The ‘309, ‘504, ‘505 and ‘794
`patents have the same inventor, substantially the same specification and there is substantial similarity in the
`language of the asserted claims of the four patents. Because of the similarity in claim language, the same claim
`construction dispute exists for all 4 patents and, thus, the parties have agreed that the claim construction dispute
`identified in the chart for the ‘309 Patent is representative of the dispute with respect to all 4 patents, and can be
`decided based on resolution of the disputed construction for the ‘309 Patent.

`III. S.P.R. 3.4.3 – IDENTIFICATION OF MOST SIGNIFICANT

`TERMS
`In accordance with S.P.R. 3.4.3, the parties have met and conferred and
`
`identified the 9 terms whose construction will be most significant to the case,
`which are listed above in section II.
`
`IV. S.P.R. 3.4.4 – TIME FOR CLAIM CONSTRUCTION HEARING
`
`The parties request more than 45 minutes total for their respective claim
`construction presentations; specifically, a total of 3 hours split evenly between the
`parties. The reason for this request is that the case has materially expanded
`through the addition of 5 patents. The parties believe the additional time is
`necessary to sufficiently describe the technology and present the disputes to the
`Court in enough detail to allow your Honor to make a reasoned determination.
