`Civil Procedure. URC bases these disclosures on information currently available

`to it arising from its investigation to date. URC’s understanding of the subject
`
`matter of this action, as well as the scope of rights claimed by Plaintiff Universal
`
`Electronics Inc. (“UEI”), arises from UEI’s service of the Complaint in this action
`
`asserting infringement of US. Patent Nos. 5,414,426 (the “ ’426 patent”),
`
`5,568,367 (the “ ’367 patent”), 5,614,906 (the “ ’ 906 patent”), and 6,587,067 (the
`
`“ ’067 patent”) (collectively, “the Asserted Patents”).
`
`The disclosures set forth herein are based on information reasonably

`available to URC following a good faith inquiry upon UEI’s commencement of

`this suit. Investigation concerning this action is ongoing, and URC reserves the

`
`URC has asserted a counterclaim of breach of contract against UEI due to a
`
`material breach of the November 1, 2004 Settlement Agreement between the
`
`parties based on the assertion of US. Patent No. 5,414,426 (“the ‘426 patent”) in
`
`this lawsuit.
`
`URC will seek damages in an amount to be determined at trial based on its
`
`attorneys’ fees and costs incurred in defending against this baseless claim.
`
`Damages are ongoing and will be computed based on the fees and costs expended
`
`up and until the claim is withdrawn by UEI or dismissed by the Court.
`
`URC expressly reserves the right to supplement this response concerning
`
`its damages computation pursuant to Rule 26(e) as its investigation continues and
`
`after discovery commences.
