`

`

`IPR2014-01092
`U.S. Pat. No. 7,434,974
`
`Pursuant to the Patent and Trademark Office's Final Rule Setting and
`
`Adjusting Patent Fees, 78 Fed. Reg. 4212, 4232-4234 (Jan. 18, 2013), Petitioner
`
`LG Display Co., Ltd., requests a refund in the amount of $14,000.00 to be paid to
`
`deposit account number 130019. If the Office determines that LG Display Co.,
`
`Ltd. is entitled to a greater refund, LG Display thereby requests the full amount
`
`be refunded.
`
`On July 1, 2014, LG Display filed a Petition for Inter Partes Review of
`
`U.S. Patent No. 7,434,974 with the Patent Trial and Appeal Board that was
`
`assigned case number IPR2014-01092. In accordance with the fee schedule
`
`specified in 37 C.F.R. § 42.15(a), LG Display deposited an electronic payment in
`
`the amount of $9,000.00 with the Board at the time of filing of its Petition to
`
`cover associated fees with LG Display's inter partes review request, and a further
`
`$14,000.00 in Post-Institution fees.
`
`On January 13, 2015, the Patent Trial and Appeal Board denied institution
`
`of IPR2014-01092. Accordingly, LG Display requests a refund in the amount of
`
`the post-institution fees that it has paid to the USPTO in connection with that
`
`proceeding in accordance with 78 Fed. Reg. 4233 (stating that "[t]he entire post-
`
`institution fee would be returned to the petitioner if the Office does not institute a
`
`review.").
