`
`
`Representative Claims of the ‘468 Patent
`
`27. A method of updating a data representative of a current
`state of an intended target appliance, comprising:
`receiving a transmission from a remote control; and
`comparing the transmission from the remote control to a
`plurality of commands to determine if the transmission from
`the remote control is one for commanding an operation of
`the intended target appliance and to update the data to
`represent the current state of the intended target appliance
`which will result from the intended target appliance
`performing the operation commanded.
`28. The method as recited in claim 27, comprising
`supplementing the data with information obtained directly
`from the intended target appliance.
`33. The method as recited in claim 27, wherein the data is
`maintained locally within a device which receives the
`transmission.
`(‘917 Patent, Ex. 1001, Claims 27, 28, 33.)

`
`Cohen Does Not Teach Updating Data Representative of a
`Current State
`
`Cohen only logs remote control transmissions
`
`(Cohen, Ex. 1005 at 5:67-6:5.)
`
`(Cohen, Ex. 1005 at 6:29-31.)

`
`
`
`Cohen Does Not Teach Updating Dating Representative of a
`Current State
`
`An “outside world” computer—separate from the
`invention of Cohen—analyzes and interprets the
`remote control signal data captured by Cohen:
`
`(Cohen, Ex. 1005 at 6:21-24.)
`
`(Cohen, Ex. 1005 at 6:57-61.)
`
`(Cohen, Ex. 1005 at 6:39-42.)

`
`
`
`Cohen Does Not Teach Updating Dating Representative of a
`Current State
`
`Channel selection is not a state
`– The ‘468 Patent does not describe channel
`selection as a state
`
`(‘468 Patent, Ex. 1001, Fig. 4.)
`– Cohen does not describe channel selection as a
`state
`– Petitioner’s expert’s “opinion” is conclusory and
`unsupported:
`“It is my opinion that channel selection is a state,
`as claimed in the ‘468 patent.” (Geier Decl., Ex.
`1008 at ¶ 40.)
