`Patent Owner’s Motion for Counsel to Withdraw

`1 This Decision addresses the same issue in each of the inter partes reviews listed
`in the Appendix. Therefore, we issue one Decision to be filed in all of the cases.
`The parties, however, are not authorized to use this style of filing in subsequent
`papers.

`Patent Owner has filed a Motion for Counsel to Withdraw and Permit
`
`Substitution of Counsel for each of the proceedings listed in the Appendix. Paper
`
`18.2 Patent Owner seeks withdrawal of its current lead counsel, Mr. Bruce J.
`
`Barker. Id. at 1. Patent Owner also seeks to designate new lead counsel, Mr.
`
`Tarek Fahmi. Id. Patent Owner indicates that Mr. Fahmi is a registered
`
`practitioner, and he has read and intends to comply with the Office Patent Trial
`
`Practice Guide and the Board’s Rules of Practice for Trials, as set forth in Part 42
`
`of Title 37, Code of Federal Regulations. Id. Petitioner does not oppose this
`
`Motion.
`
`Counsel may withdraw from an inter partes review proceeding only with
`
`authorization from the Board. 37 C.F.R. § 42.10(e). Here, we discern no reason to
`
`deny Patent Owner’s motion for counsel to withdraw. The change of counsel
`
`would not cause any prejudice to Patent Owner or unnecessary delays in the
`
`proceedings, as Patent Owner does not seek an extension of time. The motion also
`
`indicates that “[u]pon grant of this motion, current counsel for Zond will promptly
`
`file a new Power of Attorney . . . and [] Amended Mandatory Notice Information.”
`
`Paper 18, 2. In light of the foregoing, we hereby grant Patent Owner’s Motion.
`

`ORDERED that Patent Owner’s Motion for Counsel to Withdraw and
`
`Permit Substitution of Counsel is granted;
`
`FURTHER ORDERED that Mr. Bruce J. Barker is withdrawn as lead
`
`counsel from each of the proceedings identified in the Appendix;
