`The '346 Patent is a continuation of Application No. 13/194,871 filed on

`July 29, 2011, issued as U.S. Patent No. 8,079,413 ("the '413 Patent"), which is

`a continuation-in-part of Application No. 12/317,497 filed on December 23,
`
`2008, issued as U.S. Patent No. 8,496,052 ("the '052 Patent"). The '413 Patent is
`
`the subject of Inter Partes Review No. IPR2013-00231 filed on April 2, 2013 by

`the same Petitioner as the present case. Inter Partes review was instituted on

`September 23, 2013 and oral arguments were heard May 8, 2014. The parties
