`DEFENDANTS’ PROPOSED CONSTRUCTIONS
`
`
`
`Pursuant to the Court’s Scheduling Order (Dkt. No. 83) and P.R. 4-2(a-b),
`
`Defendants in the above-captioned matters (“Defendants”) submit the following list of
`

`
`

`

`This list below is preliminary and Defendants reserve the right to modify, add to,
`
`or delete from the list based on, without limitation, the list propounded by the Plaintiff,
`
`the meet and confer sessions with Plaintiff, and information learned through the course of
`
`discovery, which is still in its earliest stages. Accordingly, Defendants reserve the right to
`
`modify, add to, or delete from the list on the basis of this discovery as well. Defendants
`
`further reserve the right to refine this list by combining or dividing identified terms,
`
`phrases, or clauses in an effort to resolve any dispute that may arise as to the proper
`
`disposition of the listed terms, phrases, or clauses. Further, Defendants reserve the right
`
`to include in its list claim terms, phrases, or clauses proposed by Plaintiff. Subject to the
`
`foregoing, terms not specifically identified herein or by Plaintiff should be given their
`
`ordinary meanings.
`
`Claim Language

`All Defendants:
`
`
`Plurality of input devices
`connected to only one
`computer.
`
`
`All Defendants:
`
`[Registering] more than one
`user, such that each user is
`registered with a different
`input device.

`
`

`

`"registering different ones
`of said users with different
`ones of said devices"
`
`All Defendants:
`
`Creating and saving
`associations between users
`and input devices.
`
`2:26-37; 5:18-25; 9:30 – 51.
`
`“revokably registering […]
`users with
`[…]
`input
`devices”
`
`
`“entering … input events
`through user control of a
`plurality of input devices”
`
`Nintendo, Sony, Konami1:
`
`The association between
`one of the users and one of
`the input devices can be
`transferred to another user
`without interrupting the
`application program.
`
`
`Nintendo, Sony, Konami:
`
`The users enter the input
`events via the input devices.
`
`9:52 – 10:15, FIG. 16
`
`The claim refers to
`“entering . . . input events.”
`The specification states that
`“input events” ” refers to
`physical events on input
`devices. E.g. 8:29-31 (“The
`nature of the event may be
`the pressing of a keyboard
`key, the movement of a
`mouse, the clicking of a
`mouse, etc.”) Thus,
`“entering input events”
`means pressing a keyboard
`key, moving a mouse, etc. –
`steps that are performed by
`the system user.
`
`Further, the claim states,
`
`
`
`
`1 Respectively, Nintendo of America Inc. (“Nintendo”), Sony Computer Entertainment
`America LLC and Sony Online Entertainment LLC (collectively, “Sony”), and Konami
`Digital Entertainment, Inc. (“Konami”).
`
`3
`
`BABBAGE HOLDINGS, INC. - EXHIBIT 2001-Page 003
`
`

`

`“entering simultaneous and
`sequential input events
`through user control.” The
`phrase “user control” shows
`that the user performs the
`“entering” step.
`
`Further, the claim states,
`“each of said input devices
`having a unique identity
`that is linked by any input
`events that are entered
`thereby.” As a matter of
`grammar, “that are entered
`thereby” means “that are
`entered by the input
`devices.” Thus, the input
`devices (such as the mouse
`and keyboard) perform the
`step of “entering.” Because
`users control input devices,
`the users perform the
`“entering” step.
`US Patent 5,442,788 File
`History: 8/10/1994 OA at 3;
`11/30/1994 OA Response at
`2-3 and 7-8.
`
`Evidence preamble is
`limiting: The preamble
`contains the term
`“application program.”
`This term does not appear
`in the method until Step 4,
`which refers to “said
`application program.” A
`“preamble is held to be
`limiting [when] the
`limitations in the body of
`the claim rely upon and
`derive antecedent basis
`from the preamble.”

`Systems, Inc., 687 F.3d

`
`"simultaneous and
`sequential input events"
`
`“shared display”
`
`All Defendants:
`
`Indefinite - not amenable to
`construction
`
`All Defendants:
