`IT IS HEREBY STIPULATED AND AGREED, by and among Plaintiff

`CallWave Communications, LLC and Defendants AT&T Inc. and AT&T Mobility, LLC
`
`(collectively “the AT&T Defendants”), by and through their undersigned counsel and
`
`subject to approval of the Court, as follows:

`The AT&T Defendants each hereby agree to waive service of the
`
`summons and complaint in this case and the defense of insufficiency of such service of
`
`process;
`

`That the time for the AT&T Defendants to move, answer, or otherwise
`
`respond to Plaintiff’s Complaint is March 20, 2013;
`
`3.
`
`The reason for this requested extension is that the AT&T Defendants need
`
`more time to consider the allegations of the Complaint and determine how to respond.
