`
`Case IPR2014-00920
`U.S. Patent 6,771,970
`____________
`
`JOINT REQUEST TO TREAT SETTLEMENT
`AGREEMENT AS BUSINESS CONFIDENTIAL
`PURSUANT TO 35 U.S.C. § 317(b) AND 37 C.F.R. § 42.74(c)
`
`

`

`Pursuant to 35 U.S.C. § 317(b), 37 C.F.R. § 42.74(c), and the Board’s e-mail
`
`dated May 12, 2015, authorizing filing this joint request, Petitioner (Wavemarket
`
`Inc. d/b/a Location Labs) and Patent Owner (LocatioNet Systems Ltd.)
`
`(collectively, “the Parties”) jointly request that a true copy of the settlement
`
`agreement filed concurrently herewith as Exhibit 1121 as well as a collateral
`
`agreement filed concurrently herewith as Exhibit 1122, are treated as business
`
`confidential information and are kept separate from the file of IPR2014-00920
`
`involving U.S. Patent No. 6,771,970. Exhibits 1121-1122 are being submitted in
`
`the PRPS system as “Parties and Board Only.” As the Parties consider these
`
`agreements to be business confidential information that would substantially harm
`
`their business interests if publicly disclosed, and the agreements are subject to the
`
`confidentiality terms set forth in the settlement agreement, the Parties jointly
`
`request these agreements shall only be available under the conditions set forth in
`
`37 C.F.R. § 42.74(c)(1)-(2). By agreement, Petitioner files this request on behalf
`
`of both Parties.
