`Plaintiff Zond, LLC (“Zond”) and Defendants Fujitsu Semiconductor Limited and Fujitsu

`Semiconductor America, Inc. (together with Fujitsu Semiconductor Limited, “Fujitsu”) have
`
`agreed to dismiss without prejudice all of Zond’s claims against Fujitsu in the above-captioned
`
`action (“Action”). Therefore, pursuant to Rule 41(a) of the Federal Rules of Civil Procedure, by
`
`their undersigned representatives, Zond and Fujitsu hereby stipulate to dismissal without
`
`prejudice of Zond’s claims against Fujitsu in the Action. Zond and Fujitsu further stipulate that
`
`Zond shall not bear Fujitsu’s costs and attorneys’ fees relating to the Action, and Fujitsu shall not
`
`bear Zond’s costs and attorneys’ fees relating to the Action.
