`LLC (“Black Hills Licensees”) respectfully request confidential treatment for the business
`information contained in Confidential Exhibits 77, 78, 86, 87, 95, 96, 105, 106, 115, 116, 120,
`121, 125 through 129, and 136 through 149 and certain portion of the Verified Confidential
`Complaint The information contained in these items relate to the identity of Black Hills’
`Licensees, the terms of such licenses and information from which the identity of Black Hills’
`Licensees can be identified. The relevant licenses provide that the existence of the licenses and
`their terms are confidential. Thus, we have also included exhibits 125 through 129 and 136
`through 145 in the confidential submission. While these documents themselves are public, their
`disclosure here would serve to identify the confidential Licensees.

`This information qualifies as confidential information pursuant to 19 C.F.R. § 201.6 in
`that it discloses proprietary commercial information, proprietary commercial relationships,

`Pursuant to Commission Rule 210.8(b), Complainant Black Hills Media, LLC
`
`(“Black Hills”) submits this statement addressing the effects on the public interest of Black
`
`Hills’ complaint, filed contemporaneously herewith. As detailed below, Black Hills”
`
`submits that the issuance of the relief requested will not adversely impact the public health,
`
`safety or welfare conditions in the United States, competitive conditions in the United
`
`States economy or the production of like or directly competitive articles in the United
`
`States. The proposed investigation is expected to have the beneficial effect on the public
`
`interest of promoting and defending intellectual property rights in the United States and to
`
`have little to no adverse impact on the public interest.
`
`I.
`
`How The Articles Potentially Subject To The Requested Remedial Orders Are
`Used In The United States
`
`Generally, the Accused Products at issue include televisions, Blu-ray disc players,
`
`home theater systems, tablets and mobile telephones that are used by consumers. These
`
`products can be used to share media (e.g., songs) across various electronic devices (e.g.,
`
`phones, TVs, etc). In addition, the tablets and/or mobile phones may be used in
`
`connection with location based services for sharing information with friends and family.
`
`The Accused Products are, on information and belief, sold as stand-alone products or in a
`
`combination of one or more of the above listed devices and are imported into the United
`
`States and sold after importation.
`

`
`Public Health, Safety, Or Welfare Concerns Relating To The Requested
`Remedial Orders
`
`Black Hills is not aware of any public health, safety, or welfare concerns relating to
`
`the requested relief sought in its complaint. The products at issue are useful products, but
`
`do not implicate any public health, safety or welfare issues. Rather, the issuance of an
`

`exclusion order and cease and desist orders against the proposed Respondents will benefit
`
`the public interest by encouraging the enforcement of intellectual property rights in the
`
`United States, which promotes innovation and investment in research and development.
`

`
`Like Or Directly Competitive Articles That Complainant, Its Licensees, Or
`Third Parties Make Which Could Replace The Subject Articles If They Were
`To Be Excluded
`
`Consumers of the subject products will continue to have access to competitive
`
`products, so the exclusion from importation of the Accused Products will not harm the
`
`public interest. Black Hills’ licensees of the Asserted Patents -- 8,028,323 (“the '323
`
`patent”); 8,214,873 (“the '873 patent”); 8,230,099 (“the '099 patent”); 8,045,952 (“the '952
`
`patent”); 8,050,652(“the '652 patent”); and 6,618,593 (“the '593 patent”) -- can sufficiently
`
`provide such access.

`
`Ability Of Complainant, Its Licensees, And/Or Third Parties To Replace The
`Volume Of Articles Subject To The Requested Remedial Order In A
`Commercially Reasonable Time In The United States
`
`Licensees to the Asserted Patents include two major consumer electronics
`
`companies that on information and belief have the capacity to replace the articles subject to
`
`the requested relief. On information and belief, Black Hills’ licensees of the Patents in
`
`Suit have the capacity to replace the volume of articles subject to the requested remedial
`
`orders either immediately or in a commercially reasonable time in the United States.
`

`
`How The Requested Remedial Orders Would Impact Consumers
`
`The requested remedial orders would have little to no impact on consumers. Those
`
`operating lawfully under the Patents in Suit provide consumers with comparable offerings.

`Based on the reasons provided herein, the proposed investigation of Black Hills

`Black Hills Media, LLC (“Black Hills” or “Complainant”) requests that the

`United States International Trade Commission (“ITC”) commence an investigation under Section

`337 of the Tariff Act of l 930, as amended, 19 U.S.C. § 1337 (“Section 337”), to remedy the

`unlawful importation into the United States, the sale for importation into the United States, and/or

`the sale within the United States after importation of certain digital media devices, including
`
`televisions, Blu-ray disc players, home theater systems, tablets and mobile telephones,

`components thereof and associated software (collectively referred to as the “Accused Products”).
