`
`DETAILED ACTION
`
`Claims 1·36 are in the application.
`
`The cross·reference to related applications should be updated to reflect the present status
`
`1.
`
`2.
`
`of the parent and related applications.
`
`3.
`
`With reference to claims 4 and 17, the double period at the end of the claims should be
`
`corrected.
`
`4.
`
`With reference to claim 19 a period should be provided at the end ofthe claim.
`
`Claim Rejections- 35 USC§ 112
`
`5.
`
`The following is a quotation of the second paragraph of35 U.S.C. 112:
`
`The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the
`subject matter which the applicant regards as his invention.
`
`6.
`
`Claims 6-14 and 24-32 are rejected under 35 U.S.C. 112, second paragraph, as being
`
`indefinite for failing to particularly point out and distinctly claim the subject matter which
`
`applicant regards as the invention.
`
`In claim 6 and claim 24 the alternative language "and/or c) compensated for relative
`
`movement ... " makes these claims indefinite.
`
`In claims 7 and 25 there is no roper antecedent for "the location information" in line 1.
`
`Claim Rejections- 35 USC§ 102
`
`7.
`
`The following is a quotation of the appropriate paragraphs of35 U.S.C. 102 that form the
`
`basis for the rejections under this section made in this Office action:
`
`A person shall be entitled to a patent unless -
`
`(b) the invention was patented or described in a printed publication in this or a foreign country or in public use or on
`sale in this country, more than one year prior to the date of application for patent in the United States.
`
`Ex. PGS 1012

`

`Application/Control Number: 11/454,352
`Art Unit: 3617
`
`Page 3
`
`8.
`
`Claims 15 and 33 are rejected under 35 U.S.C. 102(b) as being anticipated by Workman
`
`et al (5,790,472).
`
`Workman et al discloses a method comprising towing an array of streamers each having
`
`positioning devices there along and including wings 14; and positioning the streamers by
`
`converting a force on the streamer positioning device into a desired roll by means of
`
`calculating devices 43.
`
`Claim Rejections- 35 USC§ 103
`
`9.
`
`The following is a quotation of35 U.S.C. 103(a) which forms the basis for all
`
`obviousness rejections set forth in this Office action:
`
`(a) A patent may not be obtained though the invention is not identically disclosed or described as set forth in
`section 102 of this title, if the differences between the subject matter sought to be patented and the prior art are
`such that the subject matter as a whole would have been obvious at the time the invention was made to a person
`having ordinary skill in the art to which said subject matter pertains. Patentability shall not be negatived by the
`manner in which the invention was made.
`
`10.
`
`Claims 16-18 and 34-36 are rejected under 35 U.S.C. 103(a) as being unpatentable over
`
`Workman et al (5,790,472).
`
`The formula used to calculate the force to position the device would have bee an obvious
`
`matter of design choice dependant on the desired movement of the streamer positioning
`
`device.
`
`Allowable Subject Matter
`
`11.
`
`Claims 1-5 and 19-23 are allowed.
`
`Conclusion
`
`12.
`
`The prior art made of record and not relied upon is considered pertinent to applicant's
`
`disclosure. Woods et al (4,709,355) and Zachariadis (4,404,664) disclose control system to
`
`position towed marine cables.
