`
`IPR2014-00645
`Patent 6,738,697
`
`
`On September 18, 2014, an initial conference call was held. The
`
`participants were Scott W. Doyle and Jonathon R. DeFosse for Petitioner
`
`Mercedes-Benz USA, LLC, Thomas J. Wimbiscus and Scott P. McBride for
`
`Patent Owner American Vehicular Sciences LLC and Judges Parvis and
`
`Anderson. Neither party filed a list of proposed motions. During the
`
`conference call, counsel for the parties indicated that the parties do not have
`
`a need to change Due Date 6 or Due Date 7 as set in the Scheduling Order
`
`dated August 28, 2014 (Paper 13), but will stipulate to different Due Dates
`
`1–5 as is authorized in the Scheduling Order.
`
`
`
`No need for a protective order was indicated by either party.
`
`The parties also indicated they were familiar with discovery practices
`
`in inter partes review and were directed to the Trial Practice Guide Section
`
`F.1 as it relates to routine discovery.
`
`Counsel for Patent Owner stated they were familiar with the
`
`procedures for filing a motion to amend. Counsel was advised to contact the
`
`Board a week or two prior to filing any motion to amend for guidance.
`
`The Board was advised no District Court actions are pending against
`
`Petitioner. Patent Owner has dismissed without prejudice all pending
`
`lawsuits against Petitioner. Notice of Change in Related Matters (Paper 14).
`
`The parties stated the dismissals were not related to any settlement
`
`discussions. If the Board can do anything to assist in settlement, the parties
`
`are encouraged to arrange a call for that purpose.
`
`
`
`
`
`It is
`
`ORDERED that all due dates set in the Scheduling Order dated
`
`August 28, 2014 (Paper 13), remain unchanged as a result of the initial
`
`conference call on September 18, 2014.
