`Antarctic AS, Olympic Seafood AS, Olympic Biotec Ltd., Avoca, Inc., Rimfrost USA,

`LLC, Bioriginal Food & Science Corp., Enzymotec Ltd., and Enzymotec USA, Inc.
`
`(collectively “Respondents”) to testify as an expert in this action.

`I understand that Complainants Neptune Technologies & Bioressources,
`
`Inc. and Acasti Pharma Inc.’s (collectively, “Complainants”) are asserting certain claims
`
`of U.S. Patent No. 8,278,351 (“the ‘35l Patent”) and U.S. Patent No. 8,383,675 (“the
`
`‘675 Patent”) against Respondents in this action. As part of my engagement by the
`
`Respondents, I have been asked to provide analysis and expert opinions regarding the
`
`authenticity, date of publication, and public accessibility of certain prior art references.
`

`If asked to do so, I anticipate testifying at trial based on the opinions
`
`expressed in this report.

`I understand that I may be asked to further elaborate on these

`positions and provide opinions on other issues.

`California, Berkeley in 1965 and a Doctorate of Philosophy in Library and Information

`Science from the University of Tokyo in 1976.

`I have over 24 years of experience working directly in the library science

`field, including serving as Director of Libraries for Northern Illinois University for 6

`years, Assistant University Librarian for Development at Northwestern University

`Library for 8 years, Assistant University Librarian for Public Services at Northwestern

`University for 4 years, Regional Librarian for the U.S. Information Service in Tokyo,

`Congress for 2 years. Since 2012, I have also served as Director of Development for the
`
`Aloha Community Library in Aloha, Oregon and was on the library’s board of directors

`before transitioning to an advisory role in the Spring of 2013.

`related issues. For example, I was hired by the State University of New York (SUNY)

`It is my opinion that General Report on Research and Development of

`Techniques in Processing and Utilization of Marine Products published by Fisheries
`
`Agency (the “General Report”),
`
`including Chapter 6 (pp. 273-307) by Takao Fujita
`
`therein (the “Fujita Reference”) was published in March 1985 and has been publicly
`
`accessible since at least as early as November 1986, at least because the General Report
`
`including the Fujita Reference was indexed, cataloged, shelved, and publicly searchable
`
`by author and title by this date at the Ministry of Agriculture, Forestry and Fisheries
`
`Library
`
`(“MAFF Library”) in Tokyo, Japan. Within a reasonable amount of time
`
`thereafter the General Report, including the Fujita Reference, was also fully cataloged
`
`and searchable by subject heading. By April 2001, the General Report, including the
`
`Fujita Reference, was also publicly accessible through the MAFF Library’s OPAC
`
`database, at
`
`least because the General Report,
`
`including the Fujita Reference, was
`
`indexed, cataloged, and publicly searchable by author, title, and keywords by that date.

`The Library of the Ministry of Agriculture, Forestry, and Fisheries (the

`“MAFF Library”) is a branch of the National Diet Library.
`

`Library is the national library of Japan and was established in 1948.

`In August 2013, I visited the MAFF Library and interviewed three of its
`
`librarians: Ms. Mayumi Sugiyama (Clerk in Charge, Communications Coordinator); Ms.
`
`Naomi Endou (Statistics and Library Materials Subsection Chief); and Mr. Yuusuke
`
`Yoshihama (Legal Expert).
`
`I have also conducted subsequent telephonic interviews with
`
`Ms. Sugiyama. During my interviews of Ms. Sugiyama, Ms. Endou, and Mr.
`
`Yoshihama, I asked them about the MAFF Library’s access policy dating back until
`
`1985.
`
`I also asked Ms. Sugiyama, Ms. Endou, and Mr. Yoshihama about the MAFF
`
`Library’s cataloging procedures and systems.
`
`These interviews confirmed the
`
`information in Paragraphs 30-35 and 38-42 below, in addition to the documents cited
`
`therein.
`

`I also submitted a written request to the Director of the MAFF Library for
`
`information regarding the library’s public accessibility and the public accessibility of the
`
`General Report, including the Fujita Reference. A true and correct copy of that request is
`
`attached hereto as Attachment F.

`In response to my request for information,
`
`the Director of the MAFF
`
`Library provided written answers bearing his seal. Attached hereto as Attachment B is a
`
`true and correct copy of those answers.

`I have also visited the MAFF Library’s website, and have reviewed the
`
`Usage Guidance provided on that website.
`
`I discussed and verified this Usage Guidance
`
`with Ms. Sugiyama, Ms. Endou, and Mr. Yoshihama. Attached hereto as Attachment C
`
`is a true and correct copy of this Usage Guidance webpage.

`The MAFF Library is generally open to the public from 9:30 AM until
`
`5:00 PM on Monday through Friday, except for certain holidays, collection organization
`
`days that are established at the beginning of each month, and other days that are specially
`
`determined by the Director of the MAFF Library. The MAFF Library has also been open
`
`to the public since at least 1985.
`

`
`interviews with Ms. Sugiyama, Ms. Endou, and Mr. Yoshihama.

`Since at least April 2001, the MAFF Library has provided public access to
`
`its library catalog via the intemet through the Online Public Access Catalog (“OPAC”)
`
`database on the MAFF Library website.
`
`I also understand from Ms. Sugiyama, who has
`
`worked at the MAFF Library since 1999, that beginning in April 2000 a trial version of
`
`the OPAC database was available to the MAFF Library staff and could be used to assist
`
`library patrons with searching.‘ The OPAC database can be searched using fields such as
`
`1 Attachment B states “[s]ince April 2001 [sic] (2000), we have been providing the database of our library
`catalog on the Internet.” Both 2000 and 2001 are identified in this statement because of the difference
`between when the OPAC database was publicly available via the intemet and when a trial version was
`available to the MAFF Librarians.

`Based on my experience and my interviews with Ms. Sugiyama, Ms.

`. Endou, and Mr. Yoshihama,
`
`I understand that before the OPAC database was
`
`implemented, the MAFF Library collection could be searched using a card catalog. This
`
`card catalog was in use before 1985 and indexed the library’s collection by fields
`
`including author, call number, accession number, title, and subject headings. The catalog
`
`entry also provided information such as the publisher name, publication date, and
`
`statement of collation. The accession number provides information about when a work
`
`was first acquired and temporarily shelved.
`
`The statement of collation includes
`
`information such as the pagination and other physical features of a work (e.g., maps or
`
`illustrations) as well as the location of a specific work within a larger compilation.
`
`Subject headings are topical or subject matter categories by which a work can be
`
`searched. The MAFF Library card catalog used the National Diet Library subject
`
`headings, which are based on the Library of Congress and Sears subject headings.
`

`In addition to the MAFF Library’s catalog (i.e., the OPAC database or
`
`card catalog) the MAFF librarians are and have been available to and skilled in assisting
`
`library patrons with searching for and locating works pertaining to specific topics or
`
`issues. The MAFF Library is a special library and its librarians are familiar with its
`
`specialized subject matter and collection. These librarians can explain to patrons how to
`
`use the library’s catalog (i.e., the card catalog or OPAC database), can help determine
`
`and suggest relevant subject headings/keywords to search, can recommend relevant
`

`sections of the library’s collection for review, and can perform their own searching based
`
`on input from library patrons.

`Before July 27, 2001, and even before July 27, 2000, a person interested in
`
`the subject matter of the General Report,
`
`including the Fujita Reference, exercising
`
`reasonable diligence would have been able to locate the General Report, including the
`
`Fujita Reference, within the MAFF Library. Library catalogs, such as the MAFF Library
`
`card catalog and OPAC database, are designed to make works of potential
`
`interest
`
`identifiable to library patrons.
`
`Indexing or cataloging the General Report by fields such
`
`as author, title, subject heading, and/or keywords accomplishes this goal by making the
`
`work searchable by these fields. Moreover, the knowledge and skill of the MAFF
`
`Library’s librarians would further ensure that one of interest in the subject matter of the
`
`General Report, including the Fujita Reference, would be able to locate the report when
`
`exercising reasonable diligence.
