`I am over 21 years of age and am competent to make this declaration.

`From Mid-1997 to April, 2002, I worked at Bracewell & Patterson, L.L.P., the
`
`law firm engaged to represent David Monroe, the named inventor on United States Patent
`
`Application No. 09/006,073 (“’073 patent application”), in the drafting and prosecution
`
`of the’073 patent application.

`The ‘073 patent application was filed on January 12, 1998 and is the patent
`
`application to which United States Patent No. 7,365,871 (“’871 patent”), the patent that is
`
`the subject of the above-captioned inter partes review proceeding, claims priority.
`

`
`On or around October of 1997, David Monroe engaged Bracewell and Patterson,
`
`L.L.P. to prepare a patent application entitled “Apparatus for Capturing, Converting and
`
`Transmitting a Visual
`
`Image Signal Via a Digital Transmission System” that was
`
`ultimately filed at the United States Patent & Trademark Office (“USPTO”) and received
`
`serial number 09/006,073.
`

`I regularly communicated with David Monroe and exchanged draft applications
`
`with David Monroe related to the ‘073 patent application from October of 1997 until the
`
`filing of the ‘073 patent application on January 12, 1998.
`

`Between October of 1997 and January 12, 1998, David Monroe sent numerous
`
`documents to me that I utilized in preparing draft versions of the patent application that
`
`ultimately became the ‘073 patent application.

`Between October of 1997 and January 12, 1998, I exchanged multiple drafts of
`
`this patent application with David Monroe and continued to revise and update these drafts
`
`based on comments from and discussions with David Monroe.

`Between October of 1997 and January 12, 1998,
`
`I worked diligently on drafting
`
`the patent application that was filed at
`
`the USPTO and received the ‘073 patent
`
`application designation.
`

`
`In my experience, the three to four month period of time that elapsed between
`
`David Monroe’s engagement of my law film to draft the patent application that became
`
`the “073 patent application and the actual filing of the application that received the ‘073
`
`patent application designation was standard for the level of sophistication and detail of
`
`the application.
`

`
`To the best of my recollection, I had a standard work load at the time of the “073
`
`patent application. and nothing caused any unusual or unexpected delays during the
`
`drafting and filing ofthe ‘073 patent application.
