`1. Stephen Baker. pursuant to the provisions of28 U.S.C. § 1746 and 37 C.F.R. §1.131.
`
`declare:
`
`1.
`
`Ex)
`
`LJ.)
`
`4.
`
`My name is Stephen Baker.
`
`1 am over the age of21 years of age and am competent to make this declaration.
`
`I worked as an employee of PhotoTelesis from June 2. 1990 to June of 1999.
`
`I worked under the direction of David Monroe and/or Bruce Mather during
`
`my time at PhotoTelesis Corporation.
`
`5.
`
`My role/job description was
`
`a Software Engineer. During my time
`
`at
`
`PhotoTelesis.
`
`I helped work on software related to image processing for product
`
`development projects having designations
`
`such as.
`
`for example.
`
`ICE (Integrated
`
`Communications Environment). I-ICT (Handheld Communications Terminal). Micro—RIT
`
`(Micro Remote Image Transceiver). Military Micro—RIT- L—RIT (Laptop Remote Image
`
`Transceiver). Micro—ICE. and PICS (Portable Image Computer System). Based on my
`
`direct knowledge of these product development projects and my understanding of United
`
`States patent no. 7.365.871 ("the "871 patent”). all of these product development projects
`
`involved the development ol‘ inventive subject matter utilized in the reduction to practice
`
`of elements of the invention of David Monroe as claimed in claims 1-15 of the '871
`
`patent.
`
`6.
`
`The ICE and Micro-ICE product development projects were directed to software
`
`having an ability to receive and transmit image data by wireless means. Specifically.
`
`Micro—1C E software. which was an extension of software developed in the ICE product
`
`development project. was capable of receiving image data from a handheld device from a
`
`
`Ix.)
`
`
`

`

`compatible remote transmitting station of a wireless telephone network. For example.
`
`one of the functionalities of software developed in the Micro-1C E product development
`
`projects was transmitting visual image data to a compatible remote receiving station 01‘ a
`
`wireless telephone network through use of a cellular telephone network. The software
`
`developed in the ICE product development project and the software developed in the
`
`Micro—ICE product development project both provided for transmitting of digitized
`
`framed images. The software developed in the ICE product development project was
`
`utilized as the image capture. storage. reception and transmission software in apparatuses
`
`developed in the PICS product development project (i.e.. the PICS workstation). the L—
`
`RIT product development program. and the IICT product development program. The
`
`software developed in the MicroIC E product development project was an enhancement 01‘
`
`that developed in the ICE product development project, which optimized reception ol‘
`
`digitized framed images that were transmitted over cellular from an apparatus deveIOped
`
`in the MicroRlT product development project. Based on my direct knowledge of the ICE
`
`and Micro-1C E product development projects and my understanding of the '87] Patent.
`
`the [C E product development project and/or Micro-ICE product development project
`
`resulted in the creation of subject matter utilized in the reduction to practice of the
`
`invention as recited in at least Claim 1 ofthe '871 patent.
`
`7.
`
`The l-ICT product development project was directed to an apparatus in the form of
`
`a handheld unit attachable to an external camera. This apparatus had a housing with the
`
`following components contained therein:
`
`a.
`
`aprocessor.
`
`b .

`the memory receiving and storing digitized framed images for allowing the
`
`digitized framed images to be accessible for selectively displaying in the
`
`display window and accessible for selectively transmitting over a wireless
`

`
`the system whereby the visual
`
`image can be
`
`viewed and framed prior to capture in the memory.
