`
`CLAIM REJECTIONS UNDER 35 U.S.C. 5103
`
`The rejection of claims 1—23 under 35 U.S.C. §lO3(a) as
`
`being unpatentable over Beller et al.
`
`(W0 97/125444; hereinafter
`
`Beller),
`
`in view of Iliff (U.S. Pat. No. 6,849,045), and further in
`
`View of Segur
`
`(U.S. Pat. No. 6,212,550) has been obviated by
`
`amendment and should be withdrawn.
`
`Beller teaches a patient terminal for home health care
`
`system (Title).
`
`Iliff teaches a computerized medical diagnostic
`
`and treatment advice systent
`
`including network access
`
`(Title).
`
`Segur
`
`teaches
`
`a method
`
`and
`
`system in a client-server
`
`for
`
`automatically converting messages from a first format to a second
`
`format compatible with a message retrieving device (Title).
`
`In contrast, claim 1 of the present invention provides a
`
`communications network comprising a communications channel,
`
`a
`
`server,
`
`a primary device,
`
`and a secondary device.
`
`The primary
`
`lO
`
`

`

`device may be
`
`in communication with the server
`
`through the
`
`communications
`
`channel.
`
`The primary device may
`
`comprise
`
`a
`
`component adapted to (i)
`
`receive one or more computer programs
`
`including one or more queries,
`
`instructions or messages as a first
`
`digital file from the server,
`
`(ii) convert the first digital file
`
`into synthesized audio transmissions, (iii) present the synthesized
`
`audio transmissions to an individual
`
`through a speaker and (iv)
`
`receive audible responses
`
`from the individual.
`
`The
`
`secondary
`
`device may be operatively connected to the primary device.
`
`The
`
`secondary device
`
`(i) may be adapted to be operated by the
`
`individual in response to the synthesized audio transmissions and
`
`(ii) may comprise a user
`
`interface adapted.
`
`to receive input
`
`responses from the individual and convert the input responses to a
`
`second digital file through speech recognition. Claims 10 and 16
`
`have similar limitations. The references, alone or in combination,
`
`do not
`
`teach or suggest each and every limitation of the claimed
`
`invention.
`
`In particular, Beller is silent regarding a component
`
`adapted to (i) receive one or more computer programs including one
`
`or more queries,
`
`instructions or messages as a first digital file
`
`from the
`
`server,
`
`(ii)
`
`convert
`
`the
`
`first digital
`
`file into
`
`synthesized audio transmissions,
`
`(iii) present
`
`the synthesized
`
`audio transmissions to an individual
`
`through a speaker and (iv)
`
`11
`
`

`

`receive audible responses
`
`from the
`
`individual,
`
`as presently
`
`claimed.
`
`Iliff and Segur do not cure the deficiencies of Beller.
`
`Specifically, Segur is silent regarding a speaker that may present
`
`the synthesized audio transmissions to an individual.
`
`At best,
`
`Segur teaches converting messages from a first communication format
`
`to a second communication format and transmitting the converted
`
`messages to a separate device. However, Segur does not
`
`teach or
`
`suggest presenting the synthesized audio transmissions
`
`to an
`
`individual through a speaker and/or receiving audible responses to
`
`one or more queries from the individual, as presently claimed.
`
`While Segur generally discusses a voice synthesizer
`
`(see Col. 2,
`
`lines 60—65), Segur discusses only limited uses of such a voice
`
`synthesizer (e.g.,
`
`to convert text messages to voiced messages).
`
`However, Segur does not
`
`teach or suggest presenting synthesized
`
`audio transmissions of queries and/or instructions to an individual
`
`through a speaker and/or receiving audible responses to one or more
`
`queries from the individual, as presently claimed. Therefore,
`
`the
`
`references, alone or in combination, do not teach or suggest each
`
`and every limitation of
`
`the claimed invention and the rejection
`
`should be withdrawn.
`
`Furthermore, Beller
`
`is silent
`
`regarding a
`
`secondary
`
`device that may (i) be adapted to be operated by the individual in
`
`response to the synthesized audio transmissions and (ii) comprise
`
`12
`
`

`

`a user
`
`interface adapted.
`
`to receive input
`
`responses
`
`front
`
`the
`
`individual and convert the input responses to a second digital file
`
`through speech recognition, as presently claimed.
`
`Iliff and Segur
`
`do not cure the deficiencies of Beller. Therefore,
`
`the references,
`
`alone or in combination, do not
`
`teach or suggest each and every
`
`limitation of
`
`the claimed invention and the rejection should be
`
`withdrawn.
`
`Claims 2—9,
`
`11—15 and 17—23 depend, either directly or
`
`indirectly,
`
`from the independent claims which are now believed to
`
`be allowable.
`
`Accordingly,
`
`the present application is in condition for
`
`allowance.
