`Notice is hereby given, pursuant to 37 CFR § 90.2(a), that Patent

`Owner Troy R. Norred, M.D. (“Norred”) hereby appeals to the United States Court
`
`of Appeals for the Federal Circuit from the Final Written Decision entered on
`
`June 25, 2015 (Paper 41) (the “Final Written Decision”), and from all underlying
`
`orders, decisions, rulings and opinions, including without limitation the Decision to
`
`Initiate Inter Partes Review entered on June 27, 2014 (Paper 13).
`

`
`In accordance with 37 CFR § 980.2(a)(3)(ii), Patent Owner Norred
`
`further indicates that the issues on appeal include, but are not limited to, the Patent
`
`Trial and Appeal Board’s application of the broadest reasonable interpretation
`
`standard, claim construction, determination of the conception date and reasonable
`
`diligence in the reduction of practice of the invention recited in claims 16 and
`
`19-24 of Norred’s U.S. Patent 6,482,228 (“’228” Patent), determination of
`
`unpatentability of claims 16 and 19-24 of the ’228 Patent under 35 U.S.C. § 102,
`

`denial of Norred’s motion to amend the claims of the ’228 Patent, and any finding
`
`or determination supporting or related to those issues, as well as all other issues
`
`decided adversely to Patent Owner Norred in any orders, decisions, rulings and

`opinions.

`Simultaneous with this submission, a copy of this Notice of Appeal is
`
`being filed with the Patent Trial and Appeal Board and the Clerk’s office for the
`
`U. S. Court of Appeals for the Federal Circuit.
