`After the foregoing Amendment, claims 1-42 are currently pending in this

`application. Claims 1-29, 32-35 and 38-40 have been amended and claims 41 and 42
`
`have been added to more distinctly claim subject matter which Applicants regard as
`
`the invention. Applicants submit that no new matter has been added by the
`
`foregoing amendments.

`Claim Rejections - 35 USC §102(e)
`
`Claims 1-29, 31, 33-35, 37 and 39-40 have been rejected under 35 U.S.C.
`
`§102(e) as being anticipated by U.S. Patent No. 6,901,104 to Du et al. (hereinafter
`
`"Du").
`
`With respect to claim 1, this claim is related to a method for providing
`
`channel assignment information to support an enhanced uplink (EL]) channel and a
`
`high speed downlink packet access (HSDPA) channel. Du fails to disclose a scheme
`
`of providing channel assignment information for the EU channel or the HSDPA
`
`channel. Du merely discloses that a dedicated uplink and downlink channel should
`
`be allocated to a mobile terminal before transmission and reception of data.
`
`The EU channel and the HDSPA channel are high speed packet access
`
`channels, which are shared channels among a plurality of WTRUs, and are
`

`completely different in nature from dedicated channels. The channel assignment
`
`for the EU or HSDPA channels is not static, (which is the case in the dedicated
`
`channels), but is dynamically adjusted depending on a plurality of factors, such as
`
`traffic, channel conditions, or the like.
`
`Moreover, in accordance with claim
`
`1 of the present invention, a specific
`
`indication is given to the WTRU indicating whether the
`
`channel assignment
`
`information is for the EU channel or the HSDPA channel.
`
`This scheme is not
`
`disclosed in Du.
`
`Du mentions allocation of a channel for a downlink and an uplink
`
`connection. However, Du fails to disclose indicating whether
`
`the channel
`
`assignment information is for the EU channel or the HDSPA channel.
`
`Du discloses
`
`as follows:
`
`For example, there may be provided a down-link control channel which
`is used to distribute control data form the base station to all the
`terminals prior to establishment of a link .... In order to transmit
`control data prior to the establishment of a link for a terminal to the
`base station, for example an up-link control channel can be used which
`is assigned by the base station, but can be used by several or all the
`terminals is referred to as a common up-link channel. (See column 4
`lines 42-54 of the corresponding US patent, US 6,901,104)
`
`Before a terminal ... can transmit and receive user data, it must be
`allocated a user channel by the associated base station ... for a down-
`link and an up-link connection or a peer-to-peer user channel. To this
`end, the base station ... transmits to the assigned terminals ... control
`data via a downlink broadcast control channel ... These control data
`inform the terminals of the instant (sequence start time) relative to the
`frame, at which the terminals may transmit a special signaling
`

`sequence. (See column 5 lines 30-42 of the corresponding US patent,
`US 6,901,104, emphasis added).
`
`In accordance with Du, a control channel is first established and control data is
`
`transmitted via the allocated control channel. No specific indication is given to the
`
`terminal whether channel assignment information is for the EU channel or the
`
`HSDPA channel. Du fails to disclose that the control data includes an indication
`
`whether the channel assignment information is for the EU channel or the HSDPA
`
`channel. Therefore, claim 1 is not anticipated by Du.
`
`With respect to claims 2-7, claims 2-7 are dependent claims of claim 1.
`
`Therefore, it is believed that claims 2-7 are not anticipated by Du for the same
`
`reasons stated above.
`
`In addition to the distinctions stated above, claims 4-7 are further
`
`distinguishable from Du for the following reason. With respect to claim 4, this
`
`claim recites that the indication is a utilization of a set of mapping combinations for
`
`channelization codes for the EU channel or the HSDPA channel. As disclosed in the
`
`specification, for example, in order to indicate that the channel assignment
`
`information is for the EU channel, a field for informing a channelization code set for
`
`the HSDPA channel is set to an invalid value for the HSDPA channel, thereby the
`
`WTRU recognizes that the channel assignment is not for HSDPA, but for the EU.
`
`This scheme is not disclosed by Du.
`

`With respect to claim 5, Du merely discloses that a CRC field is attached to a
`
`random access burst for error detection. Du fails to disclose a scheme of using a
`
`WTRU-specific CRC for indicating whether the channel assignment is for the EU
`
`channel or the HSDPA channel. Mere disclosure of attachment of the CRC is too
`
`remote to teach the scheme of using the WTRU-specific CRC for distinguishing the
`
`channel assignment information for the EU channel and the HSDPA channel.
`
`Therefore, claim 5 is not anticipated by Du.
`
`With respect to claim 6, Du fails to disclose that the WTRU-specific CRC for
`
`the EU channel is an inverted version of the CRC for the HSDPA channel. In
`
`accordance with claim 6, the WTRU performs CRC decoding by using two CRCs a
`
`received CRC and an inverted version of the received CRC. If the CRC check passes
`
`with the received CRC, the WTRU recognizes that the channel assignment
`
`information is for the HSDPA channel, and if the CRC check passes with the
`
`inverted CRC, the WTRU recognizes that the channel assignment information is for
`
`the EU channel. As indicated above, Du merely discloses an attachment of a CRC,
`
`which is too remote from the present invention. Therefore, claim 6 is not
`
`anticipated by Du.
`
`With respect to claim 7, Du fails to disclose that the WTRU-specific CRC is
`
`generated using an ID of the WTRU.
`
`Examiner asserts that the data part of the
`
`random access burst includes an ID.
`
`However, this is not a generation of WTRU-
`

`included in the data. In contrast, in claim 6 the WTRU-specific CRC is generated

`from the ID by masking the CRC with the ID of the WTRU. Therefore, claim 7 is
`
`not anticipated by Du.
`
`With respect to claims 8 and 15, these claims recite a similar limitation as is
`
`recited in claim 1, which is transmission of a message including channel assignment
`
`information and an indication of whether the channel assignment information is
`
`intended for assigning radio resources to the EU channel or the HSDPA channel.
`
`Therefore, claims 8 and 15 are not anticipated by Du for the same reason stated
`
`above with respect to claim 1.
`
`With respect to claims 9-14 and 15-21, these claims include similar
`
`limitations as are recited in claims 2-7 and therefore, are not anticipated by Du for
`
`the same reason stated above.
`
`With respect to claims 22-28, these claims 22-28 are directed to an integrated
`
`circuit (IC) including similar limitations as are recited in claims 1-7. Therefore,
`
`claims 22-28 are not anticipated by Du for the same reason stated above.
`

`channel and odd TTIs for the EU channel), and this information is sent by the RNC
`
`to the WTRU.
`
`The Examiner asserts that claim 29 is anticipated by Du because Du
`
`discloses that the switching center, or control element, (interpreted as being the
`
`RNC) produces control data containing information about a user channel to be used
`
`along with a disclosure of TDMA. Applicants respectfully disagree. The portion
`
`cited by Examiner is related to a transmitter of a base station that receives data
`
`from a data source and transmits the data to a terminal. Du fails to disclose a
`
`scheme of transmitting channel assignment information for the EU channel and the
`
`HSDPA channel in different TTIs. Therefore, claim 29 is not anticipated by Du.
`
`With respect to claim 35, this claim includes a similar limitation as is recited
`
`in claim 29. Therefore, claim 35 is not anticipated by Du for the same reason stated
`
`above.
`
`With respect to claims 31, 33-34, 37 and 39-40, these claims are dependent on
`
`claim 29 and claims 37 and 39-40 are dependent on claim 35. Therefore, claims 31,
`
`33-34, 37 and 39-40 are not anticipated by Du for the same reason stated above.
