`I, Bob McGuire, hereby declare as follows:

`I am over 18 years of age and personally competent to make this
`
`declaration, having personal knowledge of all facts set forth herein.

`I am presently an employee of Oil States Energy Services, LLC
`
`("OSES").
`
`I have been employed by OSES since 2005, when OSES acquired
`
`Stinger Wellhead Protection, Inc. ("Stinger"). I first began working for Stinger on
`
`January 1, 2001.
`

`During the mid-1990s, I was employed by BJ Services Company. In
`
`that capacity, I was at an Anadarko wellsite near Alex, Oklahoma sometime
`
`around late 1997. At that site, I saw installed on the wellhead a blowout preventer
`
`protector (or "BOP protector") that had been supplied to Anadarko by Stinger.
`

`I witnessed Anadarko trying to perform hydraulic fracturing through
`
`the Stinger BOP protector. When the pressure reached 2500-3000 pounds per
`
`square inch, which is much lower than typical pressures for fracking operations,
`
`the seal on the BOP protector failed and the tool began to leak. When the pressure
`
`was reduced, the leak stopped. The only way that could happen would be that the
`
`mandrel and seal assembly moved away from the intended sealing location because
`
`the hydraulic pressure was insufficient to hold the mandrel in position.
`
