`(1 )Das Patentamt gewährt jedermann auf Antrag Einsicht in die Akten sowie in die zu den Akten
`gehörenden Modelle und Probestücke, wenn und soweit ein berechtigtes Interesse glaubhaft gemacht
`wird. Jedoch steht die Einsicht in die Rolle und die Akten von Patenten einschließlich der Akten von
`Beschränkungsverfahren (§ 64) jedermann frei; das gleiche gilt für die Einsicht in die Akten von
`abgetrennten Teilen eines Patents (§ 60}.
`(2) In die Akten von Patentanmeldungen steht die Einsicht jedermann frei,
`1. wenn der Anmelder sich gegenüber dem Patentamt mit der Akteneinsicht einverstanden erklärt und
`den Erfinder benannt hat oder
`2. wenn seit dem Tag der Einreichung der Anmeldung oder, sofern für die Anmeldung ein früherer
`Zeitpunkt als maßgebend in Anspruch genommen wird, seit diesem Zeitpunkt achtzehn Monate
`verstrichen sind und ein Hinweis nach § 32 Abs. 5 veröffentlicht worden ist.
`(3) Soweit die Einsicht in die Akten jedermann freisteht, steht die Einsicht auch in die zu den Akten
`gehörenden Modelle und Probestücke jedermann frei.
`(4) In die Benennung des Erfinders (§ 37 Abs. 1) wird, wenn der vom Anmelder angegebene Erfinder es
`beantragt, Einsicht nur nach Absatz 1 Satz 1 gewährt; § 63 Abs. 1 Satz 4 und 5 ist entsprechend
`anzuwenden.

`§ 32 PatG
`
`(1) Das Patentamt veröffentlicht
`1. die Offenlegungsschriften,
`2. die Patentschriften und
`3. das Patentblatt.
`(2) Die Offenlegungsschrift enthält die nach § 31 Abs. 2 jedermann zur Einsicht freistehenden
`Unterlagen der Anmeldung(§ 35 Abs. 1 Nr. 2 bis 4) in der ursprünglich eingereichten oder vom
`Patentamt zur Veröffentlichung zugelassenen geänderten Form. ln die Offenlegungsschrift ist auch die
`Zusammenfassung(§ 36) aufzunehmen, sofern sie rechtzeitig eingereicht worden ist. Die
`Offenlegungsschrift wird nicht veröffentlicht, wenn die Patentschrift bereits veröffentlicht worden ist.
`(3) Die Patentschrift enthält die Patentansprüche, die Beschreibung und die Zeichnungen, auf Grund
`deren das Patent erteilt worden ist. Außerdem sind in der Patentschrift die Druckschriften anzugeben,
`die das Patentamt für die Beurteilung der Patentfähigkeit der angemeldeten Erfindung in Betracht
`gezogen hat (§43Abs. 1 ). Ist die Zusammenfassung (§ 36) noch nicht veröffentlicht worden, so ist sie in
`die Patentschrift aufzunehmen.
`(4) Die Offenlegungs‐ oder Patentschrift wird unter den Voraussetzungen des § 31 Abs. 2 auch dann
`veröffentlicht. wenn die Anmeldung zurückgenommen oder zurückgewiesen wird oder als
`zurückgenommen gilt oder das Patent erlischt, nachdem die technischen Vorbereitungen für die
`Veröffentlichung abgeschlossen waren.
`(5) Das Patentblatt enthält regelmäßig erscheinende Übersichten über die Eintragungen in die Rolle,
`soweit sie nicht nur den regelmäßigen Ablauf der Patente betreffen, und Hinweise auf die Möglichkeit
`der Einsicht in die Akten von Patentanmeldungen einschließlich der Akten von abgetrennten Teilen
`eines Patents (§ 60).

`(1 )Das Patentamt gewährt jedermann auf Antrag Einsicht in die Akten sowie in die zu den Akten
`gehörenden Modelle und Probestücke, wenn und soweit ein berechtigtes Interesse glaubhaft gemacht
`wird. Jedoch steht die Einsicht in die Rolle und die Akten von Patenten einschließlich der Akten von
`Beschränkungsverfahren (§ 64) jedermann frei; das gleiche gilt für die Einsicht in die Akten von
`abgetrennten Teilen eines Patents (§ 60}.
`(2) In die Akten von Patentanmeldungen steht die Einsicht jedermann frei,
`1. wenn der Anmelder sich gegenüber dem Patentamt mit der Akteneinsicht einverstanden erklärt und
`den Erfinder benannt hat oder
`2. wenn seit dem Anmeldetag (§35 Abs. 2) oder, sofern für die Anmeldung ein früherer Zeitpunkt als
`maßgebend in Anspruch genommen wird, seit diesem Zeitpunkt achtzehn Monate verstrichen sind und
`ein Hinweis nach § 32 Abs. 5 veröffentlicht worden ist.
