`PATENT OWNER’S REQUEST FOR ORAL ARGUMENT
`PURSUANT TO 37 C.F.R. § 42.70(a)
`
`

`

`Pursuant to 37 C.F.R. § 42.70(a), Patent Owner B.E. Technology, L.L.C.
`
`(“B.E.”) hereby requests oral argument on whether claims 2 and 3 of U.S. Patent
`
`No. 6,771,290 are patentable over PCT International Publication Number
`
`WO97/09682.
`
`The issues raised in this inter partes review are raised in IPR2014-00044,
`
`IPR2014-00040, and IPR2014-00029. In addition, the patent that is the subject of
`
`this inter partes review is at issue in IPR2014-00033. Accordingly, in the interest
`
`of efficiency and economy, B.E. requests that the oral argument requested herein
`
`be consolidated with the oral arguments requested in each of those proceedings.
`
`B.E. requests a hearing of two hours to be divided equally between the
`
`petitioners, on the one hand, and B.E., on the other. B.E. understands that the
`
`petitioners in this and the aforementioned proceedings are amenable to
`
`consolidation of the arguments and equally dividing time. The parties disagree
`
`over the length of the hearing.
`
`This request for oral argument is timely under the Board’s Scheduling Order
`
`entered April 9, 2014 (Paper 10).
`
`Date: October 31, 2014
`
`
`Respectfully submitted,
