`I have been retained by Mayer Brown, LLP on behalf of Petitioner Google

`Inc.( “Google”) as an independent expert for the above-captioned inter partes
`
`review proceeding (IPR2014-00031) and two other inter partes review proceedings
`
`involving Google (IPR2014-00033 and IPR2014-00038).
`

`I provided a Declaration in support of Google’s Petition filed with the Patent
`
`Trial and Appeal Board on October 7, 2013.

`I understand that Patent Owner B.E. Technology, LLC (“B.E. Tech”) filed a
`
`Response to Google’s Petition on July 9, 2014 in all three inter partes review
`
`proceedings (IPR2014-00031, IPR2014-00033, and IPR2014-00038).

`In its Responses, B.E. Tech takes the position that the Declarations I have
`
`previously provided are not sufficient because they are without an oath or affidavit
`
`under 37 C.F.R. § 1.68 or 28 U.S.C. § 1746.

`I hereby declare that the statements made in my October 7, 2013,
`
`Declaration, as well as the testimony I provided during my depositions on June 25-
`
`26, 2014, in these inter partes review proceedings (IPR2014-00031, IPR2014-

`00033, and IPR2014-00038), made of my own knowledge are true and that all
`
`statements and testimony made on information are believed to be true.
