`Pursuant to Local Patent Rule 2.2, Plaintiff submits its Initial Infringement Contentions.
`
`In that discovery is just commencing, Plaintiff reserves the right to supplement its these
`
`contentions if additional information is discovered.
`
`LPR 2.2(a): Claim 1 of U.S. Patent No. 8,418,432 ("'432 Patent").
`
`LPR 2.2(b): Based on present information and belief, Plaintiff identifies Defendants'
`
`products sold under the parts numbers 83308, 83020, 83022, 41830, 41714, 83322, and 83323. It
`
`is unclear whether additional part numbers are used to designate multiple rows of the
`
`aforementioned stalk stompers. As such, Plaintiff further identifies quick connect couplings
`
`listed on the following addresses:

`LPR 2.2(c): See Exhibit A.

`LPR 2.2(d): Plaintiff contends that each element of the asserted claim is met literally
`
`by each of the identified products. Plaintiff reserves the right to supplement or amend its
`
`contentions if additional information is discovered. Moreover, to the extent Defendants contend
`
`that one or more claim limitations are not met literally, Plaintiff reserves the right to supplement
`
`or amend its contentions with a doctrine of equivalents contention.
`
`LPR 2.2(e): On information and belief, Defendants induce others to infringe by way of
`
`their instructing others to use each of the identified products. On information and belief,
`
`Defendants also contribute to the infringement by others by way of their selling upgrade kits that
`
`are especially made to convert couplings on existing stalk stompers to a stalk stomper that
`
`infringes claim 1 of the '432 Patent, and that have no substantial non-infringing uses.

`Investigations are continuing. Based on present information and belief,
`
`Defendants became aware of Plaintiff's quick connect/disconnect coupling for a stalk stomper
`
`sometime after August 2010 and Mr. Daryl Peterson contacted Plaintiff to obtain samples of
`
`Plaintiff's quick connect/disconnect coupling for a stalk stomper. On or about March 9, 2011 Mr.
`
`Peterson ordered two of Plaintiff's quick connect/disconnect couplings for a stalk stomper. Based
`
`on information and belief, Defendants studied Plaintiff's quick connect/disconnect coupling for a
`
`stalk stomper and developed their own version of a quick connect/disconnect coupling for a stalk
`
`stomper. After completing their study of Plaintiff's quick connect/disconnect coupling for a stalk
`
`
`

`stomper, Mr. Peterson attempted to return Plaintiff's quick connect/disconnect coupling for a
`
`stalk stomper. After the '432 Patent was issued, Plaintiff immediately began marking its quick
`
`connect/disconnect coupling for a stalk stomper with labels with the '432 Patent number, and
`
`therefore, Defendants had at least constructive knowledge of the '432 Patent. In view of this
`
`knowledge, the copying of Plaintiff's product, and the clearly infringing nature of Defendants'
`
`products, there is an objectively high likelihood that Defendants' use, sales, and offers for sale of
`
`the accused product and upgrade kits infringed the '432 Patent, and this objectively high
`
`likelihood was known or so obvious to Defendants that it should have been known.
`
`LPR 2.2(h): Plaintiff identifies products sold as "Quick tach" stalk stompers, and
`
`include product numbers as shown in Exhibit B. Each of these products is marked with the '432
`
`Patent number.
