`filed a paper indicating that they do not
`contemplate filing any motions at this time. Is

` MR. PALYS: That's correct, Your Honor.
`At this time that's correct.
` JUDGE COCKS: Okay. And the patent
`owner has filed a paper indicating they may be
`contemplating a motion to amend. Is that correct?
` MR. RICHETTI: That's correct, Your
`Honor.
` JUDGE COCKS: Okay. Well, let me just
`before we get into that briefly ask do you have any
`concrete thoughts about a motion to amend or was
`that more of a placeholder comment, which is not
`necessary but just let's characterize it that way?
` MR. RICHETTI: Yes. I do believe, Your
`Honor, it was more of a placeholder. We haven't
`made a final decision. We're still reviewing it.

`to ask for -- to have a conference call before
`submitting one.

`That's the point of my comment, so I'm glad you are
`aware. So this conference call will not count as
`the conference that is specified by the rules.
` MR. PALYS: That's correct, Your Honor.
` JUDGE COCKS: All right. Thank you. So
`I'd actually like to speak briefly before we get to
`the scheduling order a matter -- related matters.
`The board is aware of the ex parte reexamination
`with respect to the involved payment, the
`8,217,902, and the district court litigation.
` Now, the board is also aware that the
`parties have filed a joint motion to stay the ex
`parte reexamination and that motion has not yet
`been decided but it will be decided in a separate
`order. I'd like to ask about the status of the
`district court litigation. Either party.
` MR. PALYS: Sure, Your Honor. This is
`Joseph Palys for Wintek. Just a couple points.

`Regarding the litigation right now the case is
`still pending. Discovery has begun and we're just
`starting the claim construction preliminary phase
`of the case.
` JUDGE COCKS: All right. Thank you.
` MR. PALYS: And I don't know if this is
`a good time to bring this up. I was going to wait
`till the schedule. But I just want to make sure
`the board is aware that yesterday Wintek had filed
`a new petition on the '902 that addressed four
`claims.
` We can -- I guess it would be probably
`be better to talk about that in the context of the
`scheduling order but I wanted to make sure the
`board was aware of that because it might have some
`adjustments. And we also have a motion for a
`joinder with that one.
` JUDGE COCKS: Okay. All right. Let's
`get into the scheduling order then. So it sounds
`like there -- at first blush is there any issue
`before we get into any other matter?
` MR. RICHETTI: Well, Your Honor -- this

`is Joseph Richetti for patent owner. There was one
`other issue that if I could raise before we
`actually get into the scheduling order and the
`dates, I would just request permission to do so.
` JUDGE COCKS: All right. Go ahead,
`please.
` MR. RICHETTI: Sure. While we didn't
`put down a motion for additional discovery on our
`list of motions, there has come to our attention
`that Wintek's expert has provided testimony in an
`ITC investigation. And it appears very relevant to
`some of the positions that, you know, if -- from
`what we can see from the public record it appears
`to be potentially inconsistent with statements that
`he's made in this IPR in his declaration.
` And so we weren't sure whether or not
`that would just fall under routine discovery as
`part of petitioner's burden or if it's something
`that we would need to request like additional
`discovery. And so we're really just seeking the
`Court's guidance on how to move forward with trying
`to obtain this information.

` I mean, we do have more specifics
`because, you know, we know the ITC investigation
`number and the particulars of the public documents
`that we were able to pull and why we believe
`they're relevant. But we were just -- I didn't
`know how to position it.
` It didn't seem like additional discovery
`because it seems like it falls under the routine
`discovery that the parties have to provide. But I
`just really was looking for some guidance on this
`issue.
` JUDGE COCKS: Well, so is this
`information -- have the parties discussed, whatever
`discovery is characterized as, exchanging it
`between themselves without the board's enforcement?
` MR. RICHETTI: Right. We had not, Your
`Honor. I had learned of this very recently and I
`have not had an opportunity to reach out to
`petitioner's counsel. And if the suggestion is to
`do that first, I'd be more than happy to. But I
`just didn't know -- I just didn't want it to seem
`like if there really is a need for additional

`discovery that we failed to put it down.
` JUDGE COCKS: No. I understand. You
`are not at this time prejudiced from seeking
`authorization at some later time. But, yes, having
`been through a number of these proceedings, it is
`almost universally the best approach for the
`parties to discuss prior to entering into some sort
`of motion for the discovery.
` MR. RICHETTI: Understood, Your Honor,
`and we will reach out to petitioner's counsel to
`discuss this further.
` JUDGE COCKS: Okay. Thank you. We
`would appreciate that.
` Okay. I guess now on to the dates and I
`guess the influence of this additional petition.
`We will go -- well, let's start with the petitioner
`about that issue I suppose.
` MR. PALYS: Sure, Your Honor. As far as
`the schedule is concerned for these two matters,
`the 00567 and 00568 matters, the schedules as is
`for these matters, we don't have any changes or
`edits or suggestions for that. But given the new

`mentioned, that may have an effect on it and that's
`why I wanted to take some time and talk about that
`with the board.
` JUDGE COCKS: Okay. It may very well,
`but I'm sure you can appreciate that right now is
`too preliminary to really get into adjustments of
`the schedule certainly here and in connection with
`a new petition that has not yet been -- no trial
`has yet been instituted.
` MR. PALYS: Right.
` JUDGE COCKS: So we can't really speak
`to that issue. Certainly a joinder at this point
`is premature at this point because there is nothing
`to join right now. There is nothing to join at
`this particular time. So it is unfortunately
`premature for this conversation.
` MR. PALYS: I certainly appreciate that,
`Your Honor. I just wanted to make sure that the
`board was aware of it.
` JUDGE COCKS: Well, thank you for making
`us aware. But at this point I think that's enough

` JUDGE COCKS: But as it stands now the
`parties don't have an issue with the scheduling
`order, and with the caveat that the parties may
`stipulate to changes to due dates 1 to 3 without
`any more board involvement? Just provide notice if
`that's the case.
` All right. Moving on then, I'd like the
`parties to be aware that at this time there is no
`protective order that has been entered into the
`case. Do the parties anticipate at this time a
`need for a protective order?
` MR. RICHETTI: I'm sorry. This is
`Joseph Richetti for patent owner. I guess, Your
`Honor, there could arise situations with some
`evidence potentially for secondary considerations
`where there could be a need for a protective order.
`We'd be more than happy to use the standard
`protective order through the IPR proceedings.
` JUDGE COCKS: Okay. Well, so -- and
`using the default -- by "standard" I take it you

`mean the default standing protective order that
`appears in the practice guide, appendix B, I
`believe?
` MR. RICHETTI: Yup. Right.
` JUDGE COCKS: That generally is
`preferable from the board's standpoint because it
`will almost certainly be -- any protective order is
`entered provisionally, but it would almost
`certainly be entered without any difficulty. But
`should the parties need to propose some sort of
`deviation, they should file a red-lined version and
`let us know what the deviation -- agreed-to
`deviation is. So this may be a tad preliminary,
`but just letting the parties know.
` I guess as far as discovery issues go if
`the parties would please -- we spoke of that
`briefly, if they could get together initially and
`then hopefully resolve any disputes in that regard
`between themselves, but if they can't then schedule
`a call with the board and we will proceed based on
`that call.

`the litigation, Your Honor. My understanding is
`that there may have been some very early on or
`initial settlement conference or -- you know, but
`nothing substantial. You know, I think the parties
`are still working on that, hopefully. But, again,
`I'm not involved in that side of the case.
