`pursuant to 37 C.F.R. § 42.8.

`Real Party-in-Interest
`
`Pursuant to 37 C.F.R. § 42.8(b)(1), the real party-in-interest is Wintek
`
`Corporation.
`
`II. Related Matters
`An ex parte reexamination request (Control No. 90/012,869) for the ’902
`
`patent was filed on May 17, 2013, which the U.S. Patent and Trademark Office
`
`(“Office”) granted on June 20, 2013. That reexamination request involved some of
`
`the same prior art at issue in this Petition and is now currently stayed pending
`
`resolution of this proceeding and IPR2013-00568. Exhibit 1003 previously
`
`submitted is a copy of the reexamination request. Previously submitted Exhibit
`
`1004 is a copy of the Office’s order granting reexamination. Petitioner also filed
`
`concurrently with this petition another petition for inter partes review of the ’902
`
`patent, captioned IPR2013-00568. Inter partes review was granted in that matter,
`
`which is currently on the same schedule as this trial. Petitioner also filed a third
`
`petition for inter partes review of the ’902 patent to address four dependent claims
`
`and a motion for joinder. Inter partes review was granted in that matter, captioned
`
`IPR2014-00541. The Board also granted Petitioner’s motion to join the
`
`IPR2014-00541 matter with this proceeding, and concurrently terminated the
`

`IPR2014-00541 proceeding.

`Additionally, the Patent Owner has asserted the ’902 patent against the
`
`Petitioner in a patent infringement litigation filed on May 15, 2013 in the Northern
`
`District of California (case no. 3:13-cv-2218). That litigation remains pending. To
`
`the Petitioner’s knowledge, the ’902 patent has not been subject to any post grant
`
`reviews or any other inter partes reviews.
`
`III. Lead and Back-Up Counsel and Service Information
`In accordance with 37 C.F.R. § 42.8(b)(3) and (b)(4), Petitioner identifies
`
`below updated lead and back-up counsel and service information. Prior back-up
`
`counsel Naveen Modi is replaced with Abhay A. Watwe. Petitioner submits
`
`herewith a power of attorney appointing Mr. Watwe as Wintek’s attorney
`
`associated with this inter partes review of the ’902 patent.
