`
`REMARKS
`
`Applicant respectfully requests reconsideration of the present application in View of the
`
`foregoing amendments and in View of the reasons which follow,
`
`Ciaims 1-20 are now pending in this application.
`
`Re‘ection undcr35 U.S.C.
`
`‘ 103
`
`In Section 4 oftiie Office Action, Claims 1-3 and 5&0 are rejected under 35 U.8.C. §
`
`103(a) as being unpatentable over US. Patent 6,321,232 (Jebens et al.) in view of U.S. Fatent
`
`6,348,932,01 2 (Eujisawa). Applicants assumes that Claim ‘4 was similarly rejected because it is
`
`otherwise not addressed. Applicants respectfully traverse the rejection. Neither Jebens et ai. nor
`
`Fujisawa alone or in combination disclose, teach, or suggest the claimed invention as recited in
`Claims 1-20.
`
`Claims 1-9. Claims 2-9 depend from Claim 1. Ciaim 1 has been amended and now
`
`recites:
`
`providing page building-operations, the page
`an end user facility
`building operations inciuding the design and construction of pages
`from images, text, and data availabie via said communication
`network and the generation ofa portable document format gPDF;
`file;
`
`providing imposition operations and
`a printing company facility
`generating a mate—ready file from said PDF file, the imposition
`operations inciuding the setting of pages on a particular plate as
`weli as positioning and orientation of pages on said plate;
`
`" The limitations added to Claim 1 were previously inclnded in independent Claims -10 and-
`id. With respect to claims 10, 12, and 14 and on page 4 ofthe Office Action, the Examiner
`
`states that Jebens et a]. “does not ciearly discIOse generating aPDF file from the data and .:.
`generating a plate ready file from the PDF file.” The Examiner points to Fuiisawa as providing -
`this teaching. Specifically, the Examiner states:

`

`
`

`
`Fuj'isawa discloses generating a PDF file from image data (column
`7, ill—52) and generating a plate ready file from the PDF file
`(column 7, lines ;16-30), and transmitting the data to a printer (31),
`wherein the PDF file may be converted to PostScript (column 21,
`lines 19-28).
`
`Applicants respectfully disagree.
`
`There is no suggestion or teaching in Fajisawa of performing the operation of “generation
`
`of a portable document format {PDF}fi1e” or “generating a plate«ready file from said PDF file.”
`
`Fnjisawa only discloses a “page description language file 50:“ used as an input to the “Plate
`
`Makingjl’rinting process.” (see Figures 16 and 21 and column 7, lines 41-52.) There is
`
`absolutely no disclosure, suggestion, or teaching in Fuiisawa where this “page description
`
`language file” is used to generate a plate—ready tile nor is there any disclosure whatsoever of a
`PDF file. A plate—ready file is in the form of dots or rasterized data and is the output ofthe
`prepress process that is then used as the input to the plate making/printing process as shotvn in
`
`Figures 1, 16, and 21 of Fnjisawa. In column 23, lines 27—29, Fnjlsawa states that as the “page
`
`description language, ‘PostScript
`
`and the like can'be used.”
`
`The page description language file 591 of Fuiisawa is not shown in the Figures or the text
`
`as being used to generate a plate—ready file because the “page description langpage file” is a
`
`plate—ready file. A person of ordinary skill in the art would define “page description language
`
`file” as “{sloftware that resides within a printer and defines how elements such as text and
`graphics appear on the printed page. PostScript is the industry~standard page-description
`
`language.” The Adebe® PosfScrgnt® Printing Primer, 8, Mar. 1997, Adobe Systems
`
`Incorporated, a: httpz/I'www.adciie.corn/prcductsfpostscript/pdfs/psprintprirne.pdf. {A copy-of
`
`this article is included with this Reply.) “Adobe® PostScript® is both the page description -
`
`language that describes the format of a printed page, and the system that understands that
`
`language and converts it into the pixels that are imaged onto output media.” PDFfiir Prepress

`http://wwadobe.cornfproducts/extrcmc/pd{sfPDFl’repressWorkfiowpdf (referred to herein as-
`
`' the-“Adobe White Paper"). (A copy of this article is included with this Reply.) To the contrary, -
`
`.-
`
`'
`
`a “portable document format (PDF) file” is not plate-ready. The PDF file is “output hack into the

`
`number of benefits arise when a prepress process uses PDF files instead of the PostScript
`
`Atty. Die. No. 014530—0269
`
`language as its input and output. Id. at 3.
`
`The present application states:
`
`”PDF files are consterted to a Postscript format for purposes of
`plate output. PD}? is considered a Postscript 3 format.
`Conventional hardware and software infrastructure is unavailable
`
`to accept PDE‘", but rather accepts Postscript level 2,”
`
`Thus, PDF must be converted from Postscript 3 to Postscript level 2.” (page 23, lines 11—14.)
`
`Clearly, use of a “page description language, ‘PostScript ...’ and the like” as disclosed by
`
`mm (column 21, lines 27—29) is not equivalent to “generation of a portable docoment format
`
`(PEI?) file” and "generating a plate-ready file from said PDF file.”
`
`Neither Sebens et al. nor Fuiisawa disclose, suggest, or teach “generation of a portable
`
`document format (PD?) file” or “generating a plateeready tile fiom said 9D]? tile.” As a result,
`Jebens et a1. and Fujisawa fail to disclose, suggest, or teach all of the limitations of amended I
`
`Claims l-9. An obviousness rejection cannot be properly maintained where the references used
`
`in the rejection do not disclose all of the recited claim elements. Applicants respectfully request
`
`withdrawal of the rejectiOn of Claims 1—9.
`
`Claims 10-715. Claims il-l 5 depend from Claim 10. Claim 10 recites:
`
`generating a portable document format (PDF) file from the
`designed page layout;
`
`generating a plate-ready file from said PDF file.
`
`On page 4 of the Office Action, the Examiner states that Jebens et at. “does not clearly
`
`disclose generating a PDF file from the data and generating a plate ready file from the ?DF file.” .
`
`- As noted above, the Examiner points to Fuiisawa as providing this teaching.

`
`Applicants respectfully disagree with the Examiner.
`
`In column 21, lines 27-29, mm
`
`states that as the “page description language, ‘PostScript ...’ and the like can be used." $ujisawa
`
`does not state or suggest “wherein the PDF file may be converted to PostScript.” PostScript is
`
`disclosed as a page description language. Neither a PD?‘ file nor a conversion of a PDF file to
`
`PostScript is disclosed, suggested, or taught by Fujisawa.
`
`Neither Eebens et at. not“ Fujisawa disclose, suggest, or teach “generating a portable I
`
`document format (PDF) file from the designed page layout" or “generating a plate-ready file
`
`from said PDF file.” As a result, Jebens ct al. and Fujisawa faiito disclose, suggest, or teach all
`
`of the limitations of Claims 10-15. An obviousness rejection cannot be properly maintained
`
`where the references used in the rejection do not discloSe all of the recited claim elements.
`Applicants respectfully request withdrawal of the relection of Claims 10—35.
`
`Claims 16-26. Claims 17-20 depend from Claim 16. Claim 16 recites:
`
`generating a portable document format {PDF} iile from the page
`layout designed by said remote client; ‘
`
`providing said PDF file to said remote client; and
`
`providing a plate-ready file to a remote printer.
`
`As explained with respect to Claims 1-]. 5 above, Fuiisawa does not disclose, suggest, or: -.
`
`'-
`
`teach the “generating a portable document format (PDF) file.” Fuiisawa discloses a “page
`
`description language file” wherein for the “page description language, ‘PostScript ...’ and the
`like can he used.”
`
`Neither lehens et al. nor Fuiisawa disclose, suggest, or teach “generating a portable ,
