`
`-_The fotlowing is a quotation of the appropriate paragraphs of 35 USE. 102 that
`
`form the basis for the rejections undet this section made in this Office action:
`
`A person shall be entitled to a patent unless —
`
`(e) the invention was described in a patent granted on an application for patent by another filed in the
`United States before the invention thereof by the applicanttcr patent, or on an international apptication
`by another who has tolfilted the requirements of paragraphs (1), (2). and (4) of section 371(c) of this
`title before the invention thereof by the applicant for patent.
`
`The changes made to 35 U.S.C. 102(e) by the American inventors Protection Act

`
`The following is a quotation of 35 U.S.C. 103(3) which forms the basis for all
`
`Deviousness rejections set forth in this Office action:
`
`(a) A patent may not he obtained though the invention is not identicaiiy discicssd or described as set
`forth in section 102 of this ttfle, if the differences between the subject matter sought to be patented and
`the prior art are such that the subject matter as a whole would have been obvious at the time the
`invention was made to a person having ordinary skiit in the art to which said subject matter pertains.
`Patentabiiity shat! not be negatived by the manner in which the invention was made.
`
`Claims 5, 8 and 9 rejected under 35 U.S.CA 103(3) as being unpatentahle over

`Nusbickei in view of the Wei? Known Prior Art 2144.03 iofficiai notice).
`
`Nusbickel teaches all of the subject matter upon which the claims depend except for
`
`the specific language that the communication network has to be a WAN. switched

`network or an ATM type netirvorit. Nusbickei cleariy shows a network it}? which

`in the art of image transmission and communication of images that images can be
`
`transmitted over various type of networks. Furthermore, it is well known to transmit data
`
`over switched packet networks, WANs and ATM.
`
`Hence, it would have been obvious to one of ordinary skill in the art to simply reptace
`
`the network provided by Nusbickel with a WAN, ATM or packet switched network for
`
`I the purpose of routing printing information from and end userto a printing publishing
`
`system, as suggested by Nusbickel.
`
`Claims 2, 4 and B are objected to as being dependent upon a rejected base

`ciaim, but wooid be allowable if rewritten in independent form inctuding all of the
`
`limitations of the base claim and any intervening claims.

`Ciaims 3040 are allowed.
