`
`Amendments to the Abstract:
`
`Please replace the “ABSTRACT” on page 25 with the following new Abstract:
`— The present application is directed to an interbody spinal implant having.
`
`a structural configuration that provides for maintaining the normal anatomic
`
`relationship of two adjacent vertebrae of the spine. The spinal implant is sized to
`
`fit within the disc space created by the removal of disc material between two
`
`adjacent vertebrae and conform wholly, or in part. to the disc space created.
`
`The spinal implant of the present invention has first and second sides with upper
`
`and lower bearing surfaces that form a support structure for bearing against the
`
`end plates of the adjacent vertebrae. The upper and lower bearing surfaces of
`
`the first and second sides are shaped to create an anatomic fit with the
`
`endplates of the adjacent vertebrae. —.

`
`DETAILED ACTION
`
`Drawings
`
`The drawings are objected to as failing to comply with 37 CFR l.84(p)(5) because they
`
`include the following reference character(s) not mentioned in the description: in Figures 13 and
`
`14 elements 320 and 330 are not in the written specification. Corrected drawing sheets in
`
`compliance with 37 CFR l.l2l(d), or amendment to the specification to add the reference
`
`character(s) in the description in compliance with 37 CFR l.l2l(b) are required in reply to the
`
`Office action to avoid abandonment of the application. Any amended replacement drawing sheet
`
`should include all of the figures appearing on the immediate prior version of the sheet, even if
`
`only one figure is being amended. Each drawing sheet submitted after the filing date of an
`
`application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet”
`
`pursuant to 37 CFR l.l2l(d). If the changes are not accepted by the examiner, the applicant will
`
`be notified and informed of any required corrective action in the next Office action. The
`
`objection to the drawings will not be held in abeyance.
`
`Double Patenting
`
`The nonstatutory double patenting rejection is based on a judicially created doctrine
`
`grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or
`
`improper timewise extension of the “right to exclude” granted by a patent and to prevent possible
`
`harassment by multiple assignees. A nonstatutory obviousness—type double patenting rejection
`
`is appropriate where the conflicting claims are not
`
`identical, but at
`
`least one examined
`
`application claim is not patentably distinct from the reference claim(s) because the examined
`
`application claim is either anticipated by, or would have been obvious over,
`
`the reference

`USPQ 644 (CCPA 1969).
`
`A timely filed terminal disclaimer in compliance with 37 CFR 1.321(c) or 1.321(d) may
`
`be used to overcome an actual or provisional rejection based on a nonstatutory double patenting
`
`ground provided the conflicting application or patent either is shown to be commonly owned
`
`with this application, or claims an invention made as a result of activities undertaken within the
`
`scope of a joint research agreement.
`
`Effective January 1, 1994, a registered attorney or agent of record may sign a terminal
`
`disclaimer. A terminal disclaimer signed by the assignee must fully comply with 37 CFR
`
`3.73(b).
`
`Claims 1-20 are rejected on the ground of nonstatutory obviousness—type double
`
`patenting as being unpatentable over claims 1-18 of U.S. Patent No. 7,789,914B2. Although the
`
`conflicting claims are not identical, they are not patentably distinct from each other because both
`
`cases disclose the same structure limitations.
