`I, David Johnson, declare and state as follows:

`1. I am over 18 years of age and make this declaration of
`
`my personal and firsthand knowledge. If called to testify, I could and
`
`would testify competently hereto.

`2. I own and maintain an Internet blog found at
`
`www.molej.com, where I share my experience, information, and
`
`knowledge of various topics. As part of my blog, I post reviews of
`
`products and services. Prior to posting such reviews, I become
`
`familiar with the product or service being reviewed.
`
`3. On November 13, 2009, I posted to my blog a review of
`
`a computer golf game called Golden Fairway. Prior to writing my
`
`review of Golden Fairway, I became familiar with the game by
`
`playing many rounds of Golden Fairway golf on a computer. I played
`
`the game in each of the different modes, including solo player games,
`
`multi-player games, challenge games, and online tournaments. I
`
`estimate that, in total, I played 100 rounds of golf with the Golden
`
`Fairway game.
`
`4. Attached as Exhibit 1011 is a true and correct printout of
`
`my November 13, 2009 review of Golden Fairway. I wrote the review
`
`of Exhibit 1011 shortly after personally playing, and observing the
`
`

`operation of Golden Fairway. The review of Exhibit 1011 fairly arid
`
`accurately records my observation of Golden Fairway, based upon my
`
`personal usage of the game.
`
`5. In some modes, such as in challenge games or online
`
`tournaments, Golden Fairway allowed players to play in head-to-head
`
`competition against other human players. From my experience,
`
`Golden Fairway did not offer an option to compete head-to-head
`
`against a computer-operated opponent that acted as a player in the
`
`game, Rather, from my experience, all head-to-head competition in
`
`Golden Fairway involved only human players.
`
