`Straight Path writes in response to Sipnet’s email below and to address the resulting uncertainty about the current briefing
`schedule in IPR2013-00246.
`
`Sipnet has known that it missed the deadline for its additional briefing since at least last Wednesday morning, April 6,
`2016, which is when Straight Path emailed the Board’s scheduling order to Sipnet’s counsel and informed Sipnet that it
`had failed to timely file its additional brief (due Tuesday, April 5, 2016). Straight Path took these actions because, in the
`course of investigating Sipnet’s failure to file its additional briefing, Straight Path noticed that Sipnet had provided
`incomplete and incorrect service information for its counsel and thus may not have received the Board’s scheduling order
`concerning the additional briefing. Straight Path informed Sipnet of its mistake and asked Sipnet how it intended to
`proceed.
`
`Despite this, Sipnet still has not sought to extend the briefing schedule so that it may file additional briefing. Sipnet’s below
`email suggests that it will not decide whether to move to alter the schedule until later this week, more than a week after
`Sipnet’s brief was due and it learned of its oversight.
`
`Straight Path’s own supplemental brief is currently due tomorrow, April 12, 2016. By the Board’s order, Straight Path’s
`brief was due a week after Sipnet’s so that Straight Path could respond to any arguments raised by Sipnet.
`
`Accordingly, Straight Path respectfully states that it needs to know now whether Sipnet intends to ask for, and whether it
`will be granted, additional time in which to file its tardy brief. If Sipnet is allowed additional time, Straight Path requests
`that Straight Path be allowed to file its supplemental brief a week after Sipnet’s, consistent with the Board’s original
`order. If the schedule will not be extended to allow Sipnet to file an additional brief, Straight Path intends to file its brief
`tomorrow in accordance with the original scheduling order. Either way, Straight Path should not be required to file its brief
`before Sipnet’s.
`
`Please let Straight Path know how to proceed. Straight Path is available for a conference call any time today if that would
`assist the Board.

`the deadline for filing the Petitioner's brief has already passed.
