`I, PAUL DARBEE, an applicant/inventor in the above entitled
`application hereby make the following declaration:
`1. In 1986 I, with the help of others, conceived of a
`universal remote control for operating controlled devices such
`as television sets, VCRs, cable converters, etc.
`2. In the fall/winter of 1986, I made a first prototype of
`such a universal remote control and a photograph of same is
`enclosed herewith and marked Exhibit 1.
`3 . In the fall/winter of 1986, I developed a technique for
`capturing codes from existing dedicated remote controls, for
`generating code data to emulate these codes and for inputting the
`generated code data into a RAM in the universal remote control.
`4. This technique developed in 1986 for capturing, for
`generating emulation code data and for storing such code data for
`outputting infrared codes is described in the above identified
`patent application and, except for the automation of some of the
`steps of the method, the method we use today is the same method
`used in 1986 and described in the subject patent application.
`5. In the beginning of the development of the universal
`remote control disclosed and claimed in the subject application
`our company was named Protostar Electronics and the remote
`control was referred to as the Homer Control Unit, or simply HCU
`or Homer.

`6. Ongoing development work continued on prototype models
`through early 1 9 8 7 and several more workable models were
`constructed and operated between January 1 9 8 7 and June 1 9 8 7 when
`we received production models from our manufacturer. Enclosed are
`photographs, marked Exhibits 2 and 3, of two more prototype units
`which were constructed and successfully operated prior to June
`1 9 8 7 .
`7 . Minor changes and enhancements were, and still are,
`continuously being made to the universal remote control disclosed
`and claimed in the subject application to provide a more user
`friendly and more marketable remote control, but the basic
`components and method of operation are still the same as prior
`to June 1 9 8 7 .
`8. Copies of documents evidencing the development work on
`the various prototypes between January 1, 1 9 8 7 and June 12, 1 9 8 7
`are enclosed herewith and identified as follows:
`Exhibit A - A draft of an instruction booklet for operating
`the HCU dated 2-10-87.
`Exhibit B - A copy of the circuit diagram for the HCU as it
`existed on 2-20-87.
`Exhibit C - Revision 1.1 to the HCU 1 Manual Documentation,

`photocopy enclosed herewith was made. However such comments do
`not affect the existence of this copy.

`remote control is currently being sold under the trademark "ONE
`FOR ALL"
`8. I have examined the method claims and the apparatus
`claims pending in this application and find that the steps set
`forth in the method claims were steps that were being performed
`in the time period of January 1, 1987 through June, 1987 and
`that the components of the apparatus defined in the apparatus
`claims pending in this application existed in the remote control
`prototypes that were created or existing in the time period from
`January 1, 1987 and June, 1987 in our old facilities in Tustin,
`California.
`9. I further state that the above statements were made with
`the knowledge that willful false statements and the like are
`punishable by fine and/or imprisonment, or both, under §lo01 of
`Title 18 of the United States
