`Case No. IPR2013-00071
`U.S. Patent No. 6,218,930
`OBJECTION TO EVIDENCE PURSUANT TO 37 C.F.R. § 42.64(b)(1)
`
`
`
`The Patent Owner, Network-1, objects to the admissibility of Petitioner’s
`
`Exhibit AV-1042 (Expert Report of Melvin Mercer). The basis of the objection is
`
`the evidence constitutes and contains inadmissible hearsay under Rules 801, 802
`
`and 805 of the Federal Rules of Evidence.
`
`Further, the Patent Owner objects to the admissibility of Petitioners’
`
`Exhibits AV-1026 through AV-1044. The basis of the objection is that the exhibits
`
`lack the labels required by 37 C.F.R. § 42.63(d).
