`Pursuant to 37 C.F.R. § 90.2(a), notice is hereby given that Petitioner Sony
`
`Corporation of America (“Sony”) appeals to the United States Court of Appeals for
`
`the Federal Circuit from the Final Written Decision of IPR2013-00071 entered on
`
`May 22, 2014 (Paper No. 103), and from all underlying findings, orders, decisions,
`
`rulings and opinions, including, without limitation, those within the Decision on
`
`Institution of Inter Partes Review entered on May 24, 2014 (Paper No. 18) and
`
`modified on June 11, 2013 (Paper No. 21). Sony was joined as a Petitioner with
`
`Avaya, Inc., Dell, Inc., and Hewlett-Packard CO. on September 16, 2013 (Paper
`
`No. 49) (see also Paper No. 13 in IPR2013-00495). Each of Petitioners Avaya,
`
`Dell, and Sony are concurrently filing notices of appeal in this matter.
`
`In accordance with 37 C.F.R. § 90.2(a)(3)(ii), Sony states that the issues on
`
`appeal include, but are not limited to: the decision of the Patent Trial and Appeal
`
`Board denying Petitioners’ petition to cancel claims 6 and 9 of U.S. Patent No.
`
`6,218,930 (“the ’930 patent”); the decision by the Patent Trial and Appeal Board
`
`denying certain grounds advanced by Petitioners to institute proceedings to cancel
`
`claims 6 and 9 of the ’930 patent; the claim constructions of the Patent Trial and
`
`Appeal Board; the denial by the Patent Trial and Appeal Board of Sony’s motion
`

`for joinder and any estoppel and institution denials resulting therefrom; the
`
`dismissal by the Patent Trial and Appeal Board of Petitioners’ motion to exclude
`
`evidence; and any finding or determination supporting or relating to those issues,
`
`as well as all other issues decided adversely to Petitioners in any orders, decisions,
`
`rulings and opinions.
`
`Simultaneous with this submission, a copy of this Notice of Appeal is being
`
`filed with the Patent Trial and Appeal Board. In addition, three copies of this
`
`Notice of Appeal, along with the required docketing fees, are being filed with the
`
`Clerk's Office for the United States Court of Appeals for the Federal Circuit.
