`ORDER
`Conduct of the Proceeding
` 37 C.F.R. § 42.5
`
`
`1 This order addresses an issue that is identical in all five cases. Therefore, we
`exercise discretion to issue one order to be filed in each of the five cases. The
`parties, however, are not authorized to use this style heading in subsequent
`papers since doing so may cause confusion.

`CASES IPR2013-00060, 00064, 00065, 00066, 00068
`Patent 7,697,102 B2, 7,923,311 B2, 7,876,413 B2, 8,068,204B2
`
`
`
`On April 24, 2013, the initial conference call for related cases IPR2013-
`
`00028 and IPR2013-00038 was held. During the call, counsel for CMI
`
`indicated that CMI has undergone a name change. Despite CMI counsel’s
`
`representation made during the call that the company is the same and that the
`
`real party-in-interest has not changed (that only the name of the real party-in-
`
`interest has changed), the company name change should be identified to make
`
`clear who is the petitioner in this proceeding. See 37 C.F.R. § 42.8(a)(3).
`
`Accordingly, CMI was ordered to provide an update for related cases
`
`IPR2013-00028 and IPR2013-00038. The same update would appear to be
`
`appropriate in these five related cases as well.
`
`Accordingly, it is
`
`ORDERED that CMI shall provide an update of its company name
`
`change in compliance with 37 C.F.R. § 42.8(a)(3) 2 by April 30, 2013 in the
`
`above captioned cases.

`
`
`
`
`
`
`
`
`
`
`
`
`
`
`2 In the event that the name change occurred more than twenty-one (21) days
`ago, the 37 C.F.R. § 42.8(a)(3) twenty-one (21) day requirement is waived for
`the sole purpose of allowing CMI to update its notice information. 37 C.F.R.
`§ 42.5(b).
