`Patent Owner, Mentor Graphics Corporation, files this Notice of Deposition

`pursuant to 37 C.F.R. § 42.53(d)(4). Patent Owner, by and through its attorneys,
`
`will conduct cross-examination by deposition of Petitioner Synopsys, Inc.’s
`
`declarant, Brad Hutchings, Ph.D, in IPR2012-00042 (Pat No. 6,240,376).
`
`Dr. Hutchings’ deposition will take place on September 23, 2013 beginning
`
`at 9:30 am, at the offices of O’Melveny and Myers, LLP, Two Embarcadero
`
`Center, 28th Floor, San Francisco, CA 94111, or at such other time and place as
`
`may be agreed by the parties. In particular, in a deposition scheduling discussion
`
`had between counsel for the parties on September 9, 2013, pursuant to 37 C.F.R. §
`
`42.53(d)(1), counsel for Patent Owner requested, and counsel for Petitioner agreed
`
`to investigate, the availability of Dr. Hutchings for deposition on September 20,
`
`2013, in Salt Lake City, UT. Counsel for Petitioner agreed to consent to Patent
`
`Owner’s filing and service of a deposition notice less than 10 days in advance of
`
`the deposition, given the compressed IPR schedule.
`
`
`
`The cross-examination will be taken before a Notary Public or other officer
`
`authorized by law to administer oaths and will be recorded using stenographic
`
`and/or audiotape means.
