`In the aforementioned conference call, scheduling issues were discussed in

`view of the lawsuit filed by the Patent Owner on April 29, 2013 against the Acting

`Under Secretary of Commerce and Director of the USPTO, Teresa Stanek Rea,

`under the Administrative Procedures Act (APA), Civil Action No. 1:13CV518
`
`(E.D. Va.). As discussed in the conference call, this action seeks review of the
`
`Board’s determination that 35 U.S.C. § 315(b) did not bar institution of this inter
`
`partes review. Formal notice is hereby given of this judicial matter “that would
`
`affect, or be affected by, a decision in the proceeding.” 37 C.F.R. § 42.8(b)(2).
