`settlement in a global sense of all the disputes but
`
`not a settlement discussion with respect to this
`
`specific proceeding.

`hey, we want to wait and see what happens with our

`request for rehearing before we concretely say one way

`or another we are going to tile these motions for

`discovery. But I just want to direct the parties to
`
`Rule 42.71 which says that the rehearing requests do
`
`not toll the time for taking action.
`
` So we shall proceed as if there is no
`
`rehearing request in the mix, and we are going to go
`

`forward with looking at the proposed motions for

`additional discovery.

` So with that in mind, patent owner, could

` MR. McKEE: Sure, Your Honor. Our position
`

`is that the Board has what it needs on the 315(b) bar
`

`
`issue to decide that and to dismiss the trial on that
`
`20
`
`basis. But with the decision to institute the trial,
`

`
`some issues were raised there by the Board. And so we
`
`22
`
`would seek to take discovery to address anything
`

` So what we've asked for in that connection

`is discovery on the privity relationship and also
`
`going to when that privity arose. And we've got a
`
`very concrete basis of course as set forth in our
`
`request for rehearing for pursuing this.

` What we've got is a situation where the
`
`petitioner Synopsys has acquired EVE, which was served
`
`with a complaint alleging infringement of the '376
`

`patent in 2006. And that was an acquisition which I
`

`
`believe was consummated October 4, 2012, based on an
`

`
`agreement to acquire executed on September 27.

` So we have potentially, if the Board does
`

`not adopt our position, an issue of when the privity
`
`15
`
`relationship arose. It's our position that it's
`
`16
`
`sufficient that the privity existed at the time that
`
`17
`
`the Board made its decision to institute the trial,
`
`18
`
`but we would like the opportunity if necessary to show
`
`19
`
`that a privity relationship existed on the day that
`
`20
`
`the petition was filed.

` And there's an issue of actually when the
`
`22
`
`petition was effectively filed, as we've laid out.

`And then also we'd like an opportunity to discover

`information that may show privity as far back as when
`
`the complaint was served on EVE in 2006. That is our
`
`first motion for discovery.

` Our second motion for discovery would be,

`well, let me add something as well. Also we've raised
`
`this issue of real party in interest. And EVE is now
`
`a wholly owned subsidiary of Synopsys. And we believe
`
`we are entitled to take further discovery as necessary
`

`to show that EVE may be a real party in interest. And
`

`on that basis the proceedings should not go forward.

`That's all part of Number 1.

` Number 2 has to do with assignor estoppel

`which, as we've laid out in our motions listing, we
`
`15
`
`believe applies in this case by virtue of the -- one
`
`16
`
`of the inventors of the '376 patent, Luc Burgun
`
`17
`
`assigning his rights to Mentor Graphics and then going
`
`18
`
`on to found EVE in this matter, so -- under the
`
`19
`
`doctrine of assignor estoppel. And we would urge that
`
`20
`
`that could be applied to inter partes review as well
`
`21
`
`as district court litigation. So we would be seeking
`
`22
`
`discovery on that issue as well.

`that is -- should be finally decided by the Board's
