`Dorsey & Whitney represents Jason Smith’s company, Dust Bowl,in intellectual
`property matters. Mr. Smith is the inventor and owner of US Patent 10,467,585,titled
`“Beverage Product Acquisition and Inventory ManagementSystem.” Attachment A, ‘585
`patent. The ‘585 patent was issued on November5, 2019, and claimspriority to the
`provisional application filed March 15, 2015. Mr. Smith, through Dust Bowl, developed a new
`and uniqueinventory acquisition and management system called Bar Nuvo to improve upon—
`and ultimately replace—traditional systems for managing beverage inventory in the existing
`fragmented Three-Tier system. The ‘585 patent discloses this system in detail across 19
`claims and 56figures.
`
`Wehaveclosely reviewed the Provi website and other available information regarding
`Provi’s product and ordering system. The Provi system is incredibly similar to Bar Nuvo’s
`design and the ‘585 patent. The ‘585 patentlays out the patented invention step-by-step and
`Provi's system tracks each one. For example, the ‘585 patent covers receiving an order to be
`delivered to a user’s location, identifying the distributor offering each specific product in the
`order, generating sub-orders for each distributor with a productin the order, providing
`confirmation to the user, and then allowing the userto track their order. Provi’s system appears
`to practice each one of these steps. Even specific aspects of the ordering system are present
`in both the Provi system and the ‘585 patent. For example, the Provi system prompts users
`about promotions offered by manufacturers:

`In December 2017 Mr. Smith and Dust Bowl sent a
`letter to Roland Jacobs, a memberof Dust Bowl, whois also involved with Hyde Park Angels.
`Attachment B, December12, 2017 Letter to Jacobs (minus attachments). Mr. Smith had
`learned that Provi(at that time knownas Tiz) had pitched Hyde Park Angels (including Mr.
`Jacobs) for investment. Mr. Jacob’s denies the allegations in the December 2017 letter. He
`denies that he provided any information to Provi and claims that he recused himself from
`participating in the Hyde Park Angels investmentin Tiz. Mr. Jacob's has not agreed to sign an
`agreement confirming that his denials aretrue. Attachment C, February 15, 2019 Letter to
`Jacobs. Mr. Smith has not been able to substantiate Mr. Jacob’s position to-date and reserves
`all rights regarding the same.
