`Plaintiffs and Defendant Google Inc. file this Notice of Agreed Construction, hereby
`
`notifying the Court that the parties have conferred regarding the construction of the claim term
`
`“critical file” in Claim 21 of U.S. Patent No. RE43,103, which is now asserted in the case based
`
`on the Court’s ruling at the October 28, 2016 hearing. The parties have agreed that “critical file”
`
`shall be construed as: “one or more files that are required to start or run the computer’s systems
`
`properly.” Accordingly, the construction for this term is not disputed by the parties.
`
