`On May 14, 2010 I became the attorney of record in U.S. Patent Application No.

`12/210,926, on which date I filed a power of attorney in this instant application and in a prior,
`
`co-pending application -- U.S. Patent Application No. 11/333,400 (the ‘400 application) as well.
`
`I neither prepared nor filed the two aforementioned patent applications but was retained to
`
`respond to office actions currently pending in them.
`

`During prosecution of this instant application, I did not receive any instructions from the
`
`applicants to claim a priority under 35 U.S.C. 120 to the ‘400 application. Further, I was not
`
`aware that a priority should have been claimed to the ‘400 application. It was unintentional that
`
`a claim of priority to the ‘400 application was not filed in this instant application.
