INFRINGEMENT OF U.S. PATENT NO. 8,646,093
`
`Exhibit H: ’093 Infringement Chart Against Software Asset Management (SAM), Software License Management (SLM) and related
`applications
`Claim 1
`A computer-
`implemented
`method,
`comprising:
`
`ServiceNow SAM, SLM, and Related Applications
`ServiceNow uses Software Asset Management (SAM), Software License Management (SLM) and related applications (the
`“Accused Products”) in modeling deployment of a software product and a software license contract for the software product
`(see below).1
`
`For example, Citation 1 depicts that the Accused Products manage, evaluate and track software licenses, along with
`installations and usage of software in the client environment, for the purpose of determining software license compliance.
`Citations 2 to 7 further depict that the Accused Products use contract models to store software license contracts and model
`deployment of software products on hardware, such as laptops and servers. Citations 6 and 8 further show that users can
`add custom model categories for an asset class, including software license instances, where the base system provides a
`model category for each CI class in the CMDB. Citation 9 further shows that the Accused Product creates software
`models and verifies that particular software installations are linked back to the correct model for purposes of determining
`compliance with software license rights.
`
`
`modeling
`deployment of a
`software product
`and a software
`license contract
`for the software
`product;
`
`
`
`
`1 These infringement contentions are prepared with publically available information. BMC’s investigation is ongoing and discovery has not yet begun. BMC
`reserves the right to amend or supplement these contentions after further investigation and discovery. Such supplemental information may include, but is not
`limited to, source code, data sheets, design specifications, deposition testimony, testing information, reference designs, implementation and utilization
`information, and/or schematics. BMC further reserves the right to accuse different products, or find alternative literal and/or equivalent infringing elements in
`ServiceNow’s products, based on further investigation and discovery, the claim construction process before the Court, or other circumstances so meriting. In
`addition, ServiceNow has not yet advised BMC of any non-infringement arguments, as to this or any other claim limitation. If and when it does so, BMC will
`address such arguments, including by providing any appropriate additional discussion pertaining to the application of the doctrine of equivalents with respect to
`ServiceNow’s arguments concerning non-infringement.

`The Accused Products support storing a first model of the modeled deployment of the software product in a configuration
`management database (CMDB) by storing information related to the software product as a first configuration item in the
`CMDB and by storing information related to the software license contract as a second configuration item in the CMDB.
`
`As an example, the Accused Products store information related to deployment of software products as configuration items
`(CIs) in a configuration management database (CMDB). For example, Citations 1 to 4 depict Software Models and
`Software Installations that are created both manually and by automatically populating CIs into tables in a CMDB to store
`information related to software products. Citation 5 further shows that these tables store a unique and definitive list of all

`
`As another example, Citations 6 and 7 depict that the Accused Product stores information related to software products in the
`form of the computer CIs on which software packages reside in a CMDB, and that the Accused Product stores information
`related to the software license contract in the form of a Software Package or Software Model in a CMDB.
`
`Also as an example, the Accused Product stores software license contracts using the Contract Management module. For
`example, Citations 8 to 10 depict software license contracts that are managed and tracked with the Contract Management
`module, and Citation 11 depicts storing information related to these contracts in database tables.
`
`Also as an example, Citations 12 and 13 further depict that the Accused Product stores information related to software
`license contracts using the Software Counters module.

`The Accused Products support storing a second model of the modeled software license contract for the software product in a
`license database by generating a license certificate corresponding to the software license contract and storing the license
`certificate in the license database.
`
`As an example, the Accused Products generates software license certificates and stores them in license databases. For
`example, Citations 1 to 3 depict that software licenses are based on models that specify various information, including the
`appropriate license type for the license certificate, and are created by the Accused Product using the Contract Management
`module. Citation 4 further depicts that these license certificates are stored in database tables.
`
`Also as an example, Citation 5 also depicts database tables that are used to store software license certificates.

`The Accused Products support connecting and comparing the first model and the second model by comparing the first

`responsive to comparing the first configuration item with the license certificate.
`
`As an example, the Accused Product supports Software Counters that reconcile software rights with installations to verify

`running such Software Counters, showing both rights owned and corresponding software installs deployed in the client
`environment. Citations 1 to 3 further depict that, while running Software Counters, the Accused Product connects licenses
`with contracts to restrict how the Software Counters retrieve licenses during compliance checking.
`
`In addition, as depicted in Citations 4 and 5, Software Counter Details reconciles software deployments with corresponding
`licenses and entitlements, and Software Counter Result records all the results of the software counter operations. Further,
`Citations 6 and 7 depict that in determining compliance the Software Counters use a license type parameter, for example per
`user or per workstation.
`
`Also as an example, Citation 8 depicts that the Accused Product determines compliance by comparing computer CIs to
`licenses.
`
`Also as an example, Citations 9 and 10 depict that the Accused Product connects licenses with counters after compliance
`checking by indicating in the license records the compliance status of the software package to which the license applies.
`
`Also as an example, Citation 11 depicts that the Accused Product connects licenses with software packages in connection
`with compliance checking.
