`I, Christopher K. Dorsey, declare the following to be true, to the best of my
`
`current knowledge, information, and belief:
`
`1. I am a counsel at Pillsbury Winthrop Shaw Pittman LLP, attorneys of
`
`record for Intermix Media LLC (“Intermix”) in the subject action. I have personal
`
`knowledge of the facts described herein and, if called upon, could testify compe-
`
`tently thereto.
`
`2. Intermix filed its Petition for Covered Business Method Review on June
`
`29, 2015. Attached to Intermix’s Petition were seven exhibits: Exhibits 1001-
`
`1007.
`
`3. On July 22, 2015, the Patent Trial and Appeal Board filed its Notice of
`
`Filing Date Accorded to Petition and Time for Filing Patent Owner Preliminary
`
`Response. As part of that Notice, the Board identified that Intermix’s Petition was
`
`defective because the Exhibits were not marked in accordance with 37 C.F.R. §
`
`42.63. The Notice further ordered Intermix to mark and resubmit its Exhibits ac-
`
`cording to 37 C.F.R. § 42.63.
`
`4. Per the Board’s July 22, 2015 Notice, Intermix has re-marked its Exhibits
`
`1001-1007. Other than the updated exhibit markings and the removal of the cover
`
`page Intermix had previously included with each Exhibit, Corrected Exhibits 1001-
`
`1007 are identical to the original Exhibits 1001-1007.
