` MR. OSBORNE: Of course, your Honors.
` JUDGE WHITE: All right. I think the first
`petitioner to reach out to us here was Starbucks.
` So why don't you speak to what's going on
`here as far as your objections and issues with the response
`filed by patent owner?
` MR. McKEEVER: Thank you, your Honor. This
`is Patrick McKeever for petitioner Starbucks.
` The issue is pretty straightforward from
`our perspective. The patent owner responses in the 91 and
`99 proceedings, those are the Starbucks proceedings, don't
`comply with the formatting requirements in Rule 42-6. The
`Rule requires double spacing. There's no exception for
`footnotes.
` Patent owner told us they used
`one-and-a-half line spacing in the footnotes in their
`patent owner responses in both proceedings.
` There's 88 footnotes in the 91 proceeding
`response. There's 91 footnotes in the 99 proceeding
`response. So this really adds up. It's not just in the
`sense of a couple of footnotes.

` The body text is also not double spaced, as
`required by the rule. Patent owner told us they used
`exactly 28 point line spacing, which gives you about, you
`know, an additional three to four lines per page over
`double spacing.
` There's a PTAB decision from last year
`rejecting the argument that 28 point line spacing is
`proper. That's the B/E Aerospace v. MAG Aerospace case,
`IPR-2014-01510. And it's Paper 18, which was
`February 17th, 2015.
` We tried to determine how many pages the
`responses are over the 80-page limit if the proper
`formatting was applied. And based on our analysis if
`double spacing is used for both the body text and
`footnotes, as we contend is required, they would be
`23 pages over the limit. Even if exactly 28 point line
`spacing is applied to just the footnotes, which they seem
`to acknowledge is at least required, they would still be
`15 pages over. And so this analysis was based on the
`patent owner response in the 91 proceeding.
` The obvious prejudice here is that
`petitioner Starbucks in these proceedings, we have a

`patent owner response in each of the two proceedings.
` And so we look to the PTAB for guidance on
`the appropriate form of relief here, but our preference
`would be to just strike the last 15 pages of both
`responses. That way we don't have to deal with new filings
`and figuring out what's been changed and what's not been
`changed.
` And unless your Honors have any questions
`that's really the gist of the issue for petitioner
`Starbucks.
` JUDGE WHITE: Okay. That was my
`understanding of what was going on as well.
` Do you have anything else to add,
`petitioners from the 80 and 81 cases? Or are you just
`signing on to everything that was just said.
` MR. HEINTZ: We're signing on to everything
`that was just said, your Honor. Nothing new or privileged.
` JUDGE WHITE: Patent owner, do you disagree
`with their characterization of your filings as far as the
`spacing?
` MR. OSBORNE: We do not disagree that we

`used 28.5 in the body text, and one-and-a-half spacing in
`the footnotes. But we do disagree that those formats are
`not within the rules.
` JUDGE WHITE: I would direct you to Rule
`4246(b)(3):
` Double spacing must be used excepting claim
`charts, headings, tables of content, tables of authority.
`I don't think that that rule is unclear.
` MR. OSBORNE: Okay. I appreciate your
`Honor's interpretation, but we have looked at numerous
`cases. And I quickly pulled up 20 cases after we got the
`complaint from Starbucks where less -- even less than
`one-and-a-half spacing is used for footnotes.
` So it was our understanding -- we are not
`disputing that that's the board's view. We're not
`disputing that now.
` But we believed that one-and-a-half was
`within the rules because one-and-a-half is the same as the
`block quote spacing rule. And it's just practice -- it's
`not a practice in legal filings to do footnotes the same as
`block quotes, and that's usually single spaced. So that's
`why we did it. We thought it was a well-put rule. Didn't

`even think twice about it.
` In fact, we found a lot of support in other
`papers that had been filed previously.
` JUDGE WHITE: Well, that is not the way
`that I review that rule. I think double spacing is just
`that, double spacing.
` So what I'm going to order you to do is to
`refile your papers, following the rule that the text must
`be double spaced, including the footnotes. If you have any
`block quotations, they are 1.5 space. Of course, the rule
`about margins and such, fonts are also in there. And
`that's Rule 42.6 so that you can review that rule.
` This is not something that I feel like we
`should be having to deal with in the future, so I'm looking
`at this as sort of a one-time discussion.
` I expect all parties to just follow that
`rule about formatting, and I think that there's enough
`stuff going on, and these cases are complex and many issues
`going on, and we all have very busy dockets. So rather
`than getting into this over and over again, let's just have
`you refile it by Monday, and Monday I expect to see them
`refiled with proper spacing, of course margin fonts, all

`the rules as specified in 42.7. And no new arguments. You
`can cut whatever you need to cut to reformat it to fit
`within the paper limitation.
` MR. OSBORNE: Okay. Thank you, your Honor.
`I appreciate that.
` With regard to a clarification however,
`though, they have complained about our body text being in
`28.5, which is exactly double spaced. They assert that --
`they apparently assert -- I won't put words in their mouth,
`but they apparently assert that the Microsoft default
`double spacing, which is actually larger than double
`spacing, is what we should have used.
` Could the board address that?
` JUDGE WHITE: Yes. Just use the Microsoft
`default of double space. When I looked at your papers, I
`found myself looking at about 23 lines per page. And on a
`typical double-spaced page, you get 20 lines per page, and
`over the course of an entire brief, that will add up.
` So I'm not looking for you to have to make
`any drastic changes, but I would like you to double space
`it and just to refile it Monday within the page limit.
` MR. OSBORNE: So you're saying double

`Word, but the experts in the field say that double spacing
`is double line heighths, we would could use double line
`heighth. That's double spacing.
` JUDGE WHITE: Well, I'm using Microsoft
`Word.
` Petitioner, are you using Microsoft Word?
` MR. McKEEVER: That's correct, your Honor.
` JUDGE WHITE: Well, then we all are on the
`same level playing field, and we'll all be dealing with
`double spacing as set aside by Microsoft Word. We're all
`doing the same thing.
` MR. OSBORNE: Okay. Understood, your
`Honor.
` JUDGE WHITE: Okay. Is there anything
`additional that we need at this time?
` MR. McKEEVER: Your Honor, just -- this is

`redline based on whatever the changes are that they made so
`that it's easy for us to see what's been stripped out and
`what's still there. It will make our lives a little bit
`easier, I think, for starting to work on, you know, our
`reply, of course.
` JUDGE WHITE: I don't want anything like
`that filed, but I don't see any reason why the parties --
`why you guys cannot give them a redline. Do you have any
`issues with providing a redline to petitioner?
` MR. OSBORNE: That would be a redline from
`the Word document that was actually converted and filed?
` JUDGE WHITE: What you filed right now, as
`compared to whatever you will be filing on Monday. Do you
`have an objection to providing a redline?
` MR. OSBORNE: My client has a problem with
`me giving them the native Word document, but a redline as a
`printout in PDF, we would have no problem with that.
` MR. McKEEVER: That would be fine.
` JUDGE WHITE: That would be fine. So a PDF
`version redline provided you -- guys can e-mail it or
