`This matter came to be heard on Plaintiff Trading Technologies, Inc.’s Motion to

`Reassign and Consolidate before Honorable James B. Moran. The Court has considered the

`Motion, and good cause being shown, therefore, IT IS HEREBY ORDERED THAT the
`
`motion is GRANTED.

`Case number 06-C-05222 entitled CQGT, LLC, and CQG, INC. v. TRADING
`
`TECHNOLOGIES INTERNATIONAL, INC. which is currently pending before Honorable John
`
`W. Darrah is reassigned to Honorable James B. Moran.
`

`
`Upon agreement of the parties, CQGT, LLC and CQG, Inc.’s (“CQG”) complaint
`
`in case number 06-C-05222 is dismissed without prejudice.
`

`All parties are to pay their own attorneys’ fees and costs in case number 06-C-

`05222.
`

`

`In case number 05-C-4811, Trading Technologies International, Inc. (“Trading

`Technologies”) withdraws its opposition to CQG’s Motion for Leave to File Amended Answer,
`
`Affirmative Defenses and Counterclaims, D.I. 84.

`CQG is granted leave to file its Amended Answer, Affirmative Defenses and

`Trading Technologies preserves its right to move to dismiss CQG’s amended

`answer, affirmative defenses and counterclaims.
`

`Trading Technologies has 21 days from the date of CQG’s filing of its amended

`answer, affirmative defenses and counterclaims to answer or otherwise plead.
