`CBM2013-00056
`Patent 7,970,674
`
`
`
`
`On April 10, 2014, a telephone conference call was held between respective
`
`
`
`counsel for the parties and Judges Lee and Cocks. The parties initiated the call to
`
`inform the Board that they have agreed to the option discussed in the conference
`
`call held on April 7, 2014, and summarized in Paper 19, and that Petitioner will file
`
`the new petition on April 10, 2014, with a request for joinder with this proceeding.
`
`Counsel for Patent Owner indicated that Patent Owner has agreed not to oppose the
`
`joinder request and also to waive the filing of a preliminary response for the new
`
`petition. We noted that the waiver of preliminary response has to be filed.
`
`
`
`
`
`It is
`
`ORDERED that in light of the agreement reached by the parties, Petitioner’s
`
`request (Paper 16) to submit supplemental information is dismissed as moot.
