`On April 1, 2014, an initial telephone conference call was held between
`
`respective counsel for the parties and Judges Lee, Cocks, and Kim. Both parties
`
`filed a proposed motions list.
`
`Discussion
`

`
`Neither party indicated a problem with the due dates set in the Scheduling
`
`Order (Paper 14).
`
`
`
`Counsel for the Patent Owner sought clarification of the entry for Due Date
`
`4, which reads: “Motion for observation regarding cross-examination of reply
`
`witness.” We confirmed that it applies to the reply witness of both parties,
`
`including any reply witness of the Petitioner with regard to its petition, and any
`
`reply witness of the Patent Owner with regard to a motion to amend claims.
`

`
`The Petitioner sought to make of record corresponding published patent
`
`applications of Patent 7,130,810 (“Foster”), Patent 7,120,599 (“Keyes”), and
`
`Patent 7,219,078 (“Lamont”). Counsel for the Petitioner represented that the
`
`contents of the published applications and the patents themselves, to the extent
`
`cited in the Petition, are the same. We asked the parties to confer with each other
`
`in that regard, and then initiate another conference call with the Board.

`ORDERED that the parties will jointly initiate another conference call with
`

`the Board within one week of the date of the initial telephone conference call; and

`FURTHER ORDERED that all of the Due Dates 1-7 set in the Scheduling

`Order (Paper 14) remain unchanged.
