`______________
`
`Case CBM2013-00020
`Patent 5,191,573
`______________
`
`Before the Honorable MICHAEL P. TIERNEY, JUSTIN T. ARBES, and
`GEORGIANNA W. BRADEN,
`Administrative Patent Judges.
`
`
`
`UNOPPOSED MOTION TO EXPUNGE AND REPLACE EXHIBITS 4255
`AND 4258 IN COVERED BUSINESS METHOD REVIEW OF U.S.
`PATENT NO. 5,191,573
`
`As authorized by the Patent Trial and Appeal Board in a March 28, 2014 email
`
`from the Board’s Paralegal Operations Manager, Petitioner Apple Inc. (“Petitioner”)
`
`respectfully submits this Unopposed Motion To Expunge and Replace Exhibits 4255
`
`and 4258 in Covered Business Method Review of U.S. Patent No. 5,191,573 to
`
`correct an inadvertent error in the numbering of Exhibits 4255 and 4258.
`
`On March 21, 2014, Petitioner filed a Reply and exhibits in support thereof in
`
`this matter, CBM2013-00020. Thereafter, Petitioner discovered that Exhibits 4255
`
`

`

`Case CBM2013-00020
`Patent No. 5,191,573
`and 4258 were inadvertently labeled and filed with incorrect exhibit numbers that
`
`switched the two exhibits. (In other words, the document that was labeled and filed as
`
`Exhibit 4255 should have been labeled and filed as Exhibit 4258, and the document
`
`that was labeled and filed as Exhibit 4258 should have been labeled and filed as
`
`Exhibit 4255.)
`
`Pursuant to the Board’s authorization noted above, Petitioner respectfully
`
`requests that the Board expunge and permit Petitioner to replace the versions of
`
`Exhibit 4255 and 4258 currently on file with the corrected Exhibits 4255 and 4258,
`
`reflecting the corrected exhibit number labels, and submitted herewith. Both
`
`documents have unchanged in content, and both documents conform to the
`
`requirements of 37 C.F.R. §§ 42.6 and 42.63.
`
`Patent Owner SightSound Technologies, LLC has stated that it does not
`
`oppose the relief sought in this motion.
`
`
`
`
`
`Dated: April 1, 2014

`Respectfully submitted,
