`The claims are deemed allowable over the prior art of record for

`The prior art of record does not teach, nor fairly suggest, the use
`of one or more constraints specified for each of a first portion of
`the nodes that define a scope of the subset of items represented
`by each of the first portion relative to their parent node and a
`second portion of the nodes that specify no constraints, wherein
`each of the second portion establishes a logical grouping defining
`a scope of the subset of items represented by each of the second
`portion, operatively coupled as claimed.

`Independent claim 1 is statutory subject matter under 35 U.S.C.
`
`§ 101 in light of In re Lowry. The claimed functional descriptive
`material (i.e., hierarchical data structure) is stored in a database,
`
`(i.e., on a computer-readable medium) and therefore the
`
`functional descriptive material becomes structurally and
`
`functionally interrelated to the medium and provides tangible
`
`benefits.
