`Pursuant to 37 C.F.R. § 42.70, Patent Owner Markets-Alert Pty. Ltd.

`(“Markets-Alert”) hereby respectfully submits this Request for Oral Argument for
`
`December 19, 2013, the date set by the Board’s Scheduling Order. See Scheduling
`
`Order, Paper 19. The issues requested for argument are:
`
`1.
`
`That proposed substitute Claims 5-8 should be granted pursuant to 37
`
`C.F.R. § 42.221 because they are supported, do not enlarge scope or introduce new
`
`matter, and respond to the unpatentability grounds granted review;
`
`2.
`
`That the claims of U.S. Patent No. 7,941,357 are patentable over the
`
`prior art of record; and
`
`3.
`
`That Exhibit Nos. 1036-1041 and portions of Exhibit No. 1043 should
`
`be excluded for failure to comport with the Federal Rules of Evidence.
`
`If the Board has any questions, comments, or suggestions, the undersigned
